REGULAR MEETING <br />ADOPTION OF RESOLUTION NO. 15, 1980 (TRANSFER OF REAL <br />ESTATE TO PARK DEPARTMENT) <br />RESOLUTION NO. 15, 1980 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, INDIANA, <br />AUTHORIZING THE TRANSFER OF CERTAIN REAL <br />ESTATE TO ITS DEPARTMENT OF PUBLIC PARKS <br />JULY 28. 1980 <br />WHEREAS, the City of South Bend has heretofore acquired <br />real estate described herein for the purpose of construction <br />of a retention basin for the control of storm water in the <br />Randolph Street area of the City; <br />WHEREAS, construction of the storm water retention basin <br />in this area has been completed and the herein described real <br />estate was not used in the actual construction of such basin, . <br />but adjoins the basin and is low -lying property unsuited for <br />private development. The Department of Public Parks has <br />developed adjacent real estate for park department purposes <br />and it now wishes to utilize the herein described real estate <br />for further park development, which uses would be for a public <br />purpose and would be of use and benefit to the City of South <br />Bend and its residents; <br />WHEREAS, the City of South Bend now wishes to take the <br />necessary action pursuant to Chapter 14.5 of the Municipal <br />Code of the City.of South Bend to transfer the herein described <br />real estate to its Department of Public Parks for such purposes. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works <br />of the City of South Bend, Indiana: <br />SECTION I. That the following described parcels of real <br />estate owned by the City of South Bend are not necessary to <br />the use by the City for the purposes for which they were <br />originally acquired, are not suitable for sale by the City <br />for use and development for non- public purposes, and should <br />be conveyed to the Department of Public Parks of the City of <br />South Bend for use and development for park purposes, said <br />real estate being located in the City of South Bend, St. <br />Joseph County, Indiana, and described as follows: <br />(See Exhibit A attached hereto) <br />SECTION II. This resolution shall, immediately upon its <br />adoption, be submitted to the Common Council of the City of <br />South Bend pursuant to Chapter 14.5 of the Municipal Code of <br />the City of South Bend, and specifically Section 14.5 -2(h) <br />providing for disposition of real property to other public <br />bodies for public purposes. <br />Adopted this 28th day of July, 1980. <br />Attest: <br />s/ Barbara J.
