Magliozzi <br />E=xecutive Director Assistant Director <br />Phone 574 235 -9571 www. stjosephcountyindiana .com /areaplan Fax 574 235 -9813 <br />September 22, 2010 <br />The Honorable Council of the City of <br />South Bend <br />4th Floor, County -City Building <br />South Bend, IN 46601 <br />RE: A proposed ordinance of Stadium Place Developers, LLC to zone from R Single family <br />District (County) and PUD Planned Unit Development District (South Bend) to PUD <br />Planned Unit Development District (South Bend), property located at 54703, and 54719 <br />Willis Avenue and 1855 Vaness Street, City of South Bend - APC# 2566 -10 <br />Dear Council Members: <br />I hereby Certify that the above referenced ordinance of Stadium Place Developers, LLC was <br />legally advertised on Thursday, September 9, 2010 and that the Area Plan Commission at its <br />public hearing on'Tuesday, September 21, 2010 took the following action: <br />Upon a motion by Richard Warner, being seconded by Donna Chamblee and <br />unanimously carried, the proposed ordinance of Stadium Place Developers, LLC to <br />zone from R Single Family District (County) and PUD Planned Unit Development <br />District (South Bend) to PUD Planned Unit Development District (South Bend), <br />property located at 54703, 54719 and 54739 Willis Avenue and 1855 Vaness Street, <br />City of South Bend is sent to the Common Council with a favorable <br />recommendation. The petition is consistent with recent developments in this area. <br />Previous approvals for this and surrounding sites has established Vaness Street as a <br />higher density, pedestrian - orientated area, connecting the University of Notre Dame <br />campus with the State Road 23 commercial/business corridor. <br />PLEASE NOTE that the Ordinance has been amended by the petitioner and is different <br />than that used for the Common Council's first reading. The amended Ordinance was legally <br />advertised and heard by the Area Plan Commission. <br />The deliberations of the Area Plan Commission and points considered in arriving at the above <br />decision are shown in the minutes of the public hearing, and will be forwarded to you at a later <br />date to be made a part of this report. <br />Sincerely, 9 <br />ohn W.
