ORDINANCE N0. ~CJ l l AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY All streets and alleys south of vacated Keasey Street between east of Fellows Street, north of Wenger Street ,and west of Marietta Street. All more particularly described as follows. STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. The Common Council of the City of South Bend having held a public hearing on the petition to vacate the following property: DESCRIPTION OF STREET VACATION RUSH STREET A parcel of land located from the north right-of-way of E. Wenger Street to the south right-of-way line of vacated E. Keasey Street for a distance of approximately 278 feet and a width of 48 feet. Part located in Wenger's 4th Addition, City of South Bend, Indiana. DESCRIPTION OF ALLEY VACATION 14 FEET WIDE NORTH-SOUTH ALLEY A parcel of land described as the first north-south alley east of S. Fellows Street from the north right-of-way of E. Wenger Street to the south right-of-way of vacated E. Keasey Street for a distance of approximately 278 feet and a width of 14 feet. Part located in Wenger's 4th Addition, City of South Bend, Indiana. DESCRIPTION OF ALLEY VACATION 14 FEET WIDE NORTH-SOUTH ALLEY A parcel of land described as the first north-south alley west of Marietta Street from the north right-of-way of vacated E. Wenger Street to the south right-of-way of vacated E. Keasey Street for a distance of approximately 278 feet and a width of 14 feet. Part located in Wenger's 4th Addition, City of South Bend, Indiana. DESCRIPTION OF ALLEY VACATION 14 FEET WIDE EAST-WEST ALLEY A parcel of land described as the first east-west alley north of E. Wenger Street from the east right-of-way of S. Fellows Street to the west line of the first north-south alley east of S. Fellows Street for a distance of approximately 198 feet and a width of 14 feet. Part located in Wenger's 4th Addition, City of South Bend, Indiana.
