`~ <br />ORDINANCE NO . ~ ~~~ ~ ~~ <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA, AMENDING CHAPTER 2, ARTICLE 14 OF THE <br />SOUTH BEND MUNICIPAL CODE BY THE ADDITION OF NEW <br />SECTION 2-170.6 ENTITLED <br />"RECREATION DEPARTMENT NON-REVERTING FUND" <br />STATEMENT OF PIIRPOSE AND INTENT <br />The Common Council recognizes that pursuant to Indiana Code §36- <br />10-4-16(g), it has the authority to establish by Ordinance special <br />non-reverting operating funds and special non-reverting capital funds. <br />In each instance, the establishment of such funds are to be requested <br />by the Board of Park Commissioners. <br />The Board of Park Commissioners of the City of South Bend at its <br />meeting of December 16, 1996, requested that the Common Council <br />establish a non-reverting fund. The funding mechanism for the new <br />fund would be user fees and charges associated with certain self <br />supporting activities of the South Bend Recreation Department approved <br />by the Park Board at its meeting of December 16, 1996, including the <br />aquatics and athletic programs, recreation centers, and general <br />administrative and programming, as well as other self supporting <br />Recreation Department programs as the Park Department may designate <br />from time to time. <br />The Park Board has determined that in order to provide and make <br />available to the public, quality recreational activities, the selected <br />fees should be deposited into a separate non-reverting fund. <br />Accordingly, fees generated by certain designated Recreation <br />Department activities will be deposited into the Recreation Department <br />Non-Reverting Fund. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY <br />OF SOUTH BEND, INDIANA, as follows: <br />Section 1. Chapter 2, Article 14, of the South Bend Municipal <br />Code is hereby amended by the addition of new Section 2-170.6 which <br />shall read in its entirety as follows: <br />Sec. 2-170.6 Recreation Department Non-Reverting Fund. <br />(a) The Recreation Department Non-Reverting Fund is <br />established pursuant to I.C. 36-10-4-16. <br />(b) All charges for participation in designated and self <br />supporting Recreation Department activities and programs and/or <br />use of Recreation Department facilities shall be deposited into <br />this special fund. <br />(c) Funds may only be expended for capital improvements or <br />activities directly related to Recreation Department activities, <br />programs and facilities upon passage of a proper appropriation <br />ordinance by the Common Council: Provided, however, that subject <br />to the deposit into the Recreation Department Non-Reverting Fund <br />of the sufficient revenues to support the same, the Park <br />Department may, throughout each fiscal year, make such budget <br />adjustments as may be necessary to operate the indicated programs <br />and facilities . <br />(d) Any and all interest earned on the monies deposited in <br />this special fund shall remain a part of the Recreation <br />Department Non-Reverting Fund. <br />Section 2.
