REGULAR MEETING DECEMBER 8, 2010 103 <br />ARSONS 9 8 - 1 41 51 10 <br />GRAND TOTAL 619 561 58 6382 6229 - 153 <br />APPROVE FINDINGS OF FACT - CHARGE 2010 -07 — CHARLES FLANAGAN <br />In a Memorandum to the Board, Mr. Bodnar stated that on November 17, 2010, Sergeant <br />Flanagan was served a letter from the Clerk of the Board of Public Safety with a copy of a letter <br />of recommended discipline from Police Chief Darryl Boykins. Ms. Martin's letter advised <br />Sergeant Flanagan of his rights including his right to request, within five (5) days, a Hearing <br />before the Board of Safety. Sergeant Flanagan did not respond to the letter, and the five (5) days <br />passed. In his letter, Chief Boykins recommended that for his actions that violated the South <br />Bend Police Department Duty Manual Sections 302.00(A)(1)(9)(46) and (51), failure to secure <br />evidence in accordance with Department procedures, Sergeant Flanagan receive a three (3) day <br />suspension without pay and be demoted to the rank of Corporal. Upon a motion by Mr. <br />BonDurant, seconded by Mr. Miller and carried, the Findings of Fact were approved and signed. <br />APPROVE FINDINGS OF FACT - CHARGE 2010 -08 — RICK MCGEE <br />In a Memorandum to the Board, Mr. Bodnar stated that on November 17, 2010, Lieutenant Rick <br />McGee was served a letter from the Clerk of the Board of Public Safety with a copy of a letter of <br />recommended discipline from Police Chief Darryl Boykins. In his letter, Chief Boykins recommended that for his actions that violated the South <br />Bend Police Department Duty Manual Section 302.00(20), entitled Rules of Conduct, Lieutenant <br />McGee receive a five (5) day suspension without pay and be demoted to the rank of Corporal. <br />Upon a motion by Mr. BonDurant, seconded by Mr. Miller and carried, the Findings of Fact <br />were approved and signed. <br />FIRE DEPARTMENT <br />APPROVE RECOMMENDATIO TO HIRE FIRE DEPARTMENT APPLICANT — STEPHEN <br />HARMON <br />Chief Howard Buchanon submitted to the Board a letter requesting permission to hire one (1) <br />Fire Recruit as a probationary firefighter. Mr. Harmon will attend the recruit class scheduled to <br />begin on November 30, 2010, for a period of approximately twenty (20) weeks with an effective <br />date of hire as Firefighter of December 8, 2010. Therefore, Ms. Vasquez made a motion that the <br />recommendation be approved. Mr. Miller seconded the motion which carried. <br />SWEARING IN OF FIREFIGHTER — STEPHEN HARMON <br />In a letter to the Board, Chief Howard Buchanon, recommended Stephen Harmon be accepted <br />for employment on a probationary basis with the South Bend Fire Department effective <br />December 8, 2010. He has met the requirements of the application process of the South Bend <br />Fire Department. Upon a motion made by Ms. Vasquez, seconded by Mr. Miller and carried, the <br />recommendation was approved. <br />Mr. John Voorde, City Clerk, administered the Oath of Office to Mr. Harmon. The Board wished <br />him well in his endeavor with the South Bend Fire Department. <br />ACCEPT AND APPROVE PROMOTION LIST <br />Jason Biek <br />James Biernacki <br />Joshua Comeau <br />Karl Hopkins <br />Ryan Kakalia <br />Mark Mammon <br />Nick Miller <br />Corey Powell <br />Aaron Randal <br />Jason Roose <br />Mike Williamowski <br />Matt Zimmerman <br />In a letter to the Board, Chief Buchanon recommended the above listed individuals be approved <br />for the list of candidates eligible for promotion from the rank of of 2 Class Firefighter to the <br />rank of Engineer, effective November 26, 2010, Chief Buchanon noted that the list is in <br />compliance with the 1994 Salary Ordinance which states that the rank of Engineer is a <br />promotable rank. Upon a motion made by Ms. Vasquez, seconded by Mr. Miller and carried, the <br />above list of candidates eligible for promotion to Engineer was accepted and approved. <br />
