PUBLIC AGENDA SESSION DECEMBER 8, 2010 98 <br />The Board of Public Safety met in the Public Agenda Session at 8:05 a.m. on Wednesday, <br />December 8, 2010 with Board Members Patrick Cottrell, Bruce BonDurant, Laura Vasquez, and <br />Eddie Miller present. Board President Juanita Dempsey was absent. Also present were Board <br />Attorney Thomas Bodnar, Police Chief Darryl Boykins, and Fire Chief Howard Buchanan. <br />The meeting was held in the Board of Public Works Meeting Room, 13th Floor, County City <br />Building, South Bend, Indiana. <br />Board members discussed the following items: <br />- Additions to the Agenda <br />Board Attorney Thomas Bodnar noted the addition of six (b) items to the agenda. The <br />Police Department added Resolution No. 81 -2010, a donation, Monthly Statistical <br />Analysis, and Findings of Fact for Charges 201007 and Charges 2010 -08. The Fire <br />Department added Resolution No. 82 -2010. Mr. Bodnar stated that due to all of the <br />additions and the length of the agenda, the Board should do the Swearing In of the <br />officers first so the public doesn't have to sit through the entire meeting. <br />- Police Selection Panel Recommendation — Police <br />Police Chief Daryl Boykins informed the Board that Brandon Martin was being sworn in <br />today to replace a retiring officer. He noted that Brandon has a background in law <br />enforcement and holds a criminal justice degree. <br />- Resolution No. 81 -2010 — Reorganizing the Ranks of the South Bend Police Department <br />Mr. Bodnar informed the Board that during negotiations over the last two (2) years, there <br />have been discussions regarding eliminating the rank of Corporal, and replacing it with <br />the rank of Patrolman 1" Class. He noted that the salary for Patrolman 1St Class has been <br />raised per the most recent salary ordinance passed by the Common Council, to that of the <br />Corporal salary. Therefore, the rank of Corporal is being replaced. Chief Boykins stated <br />new badges will not be purchased at this time, but may be purchased at a later time. He <br />noted cloth badges are sufficient. <br />- Findings of Fact — Charges 2010 -07 and Charges 2010 -08 <br />Mr. Bodnar stated a letter dated November 17, 2010, was served by the Police <br />Department from the Clerk of the Board of Safety on Sergeant Charles Flanagan and <br />Lieutenant Rick McGee, advising them of their rights regarding the discipline <br />recommendation by Police Chief Boykins. In the letter they were advised of the right to <br />request a Hearing within five (5) days. Neither officer responded requesting a Hearing. <br />Subsequently, the Board is being asked to approve the Findings of Fact, approving the <br />recommended discipline of Chief Boykins. <br />- Approve Hiring of Probationary Firefighter --- Fire Department <br />Mr. Bodnar stated that Stephen Harmon, being sworn in today, comes from the <br />Chesterton Fire Department. He noted the Board is authorized by Statute to allow officers <br />to transfer from one department to another providing that the requirements set by the <br />statutes have been met and the officer completes the training required by the new <br />department. Fire Chief Buchanon stated it was necessary to transfer him before his <br />birthday to allow him to continue his eligibility for PERF. He stated if the Department <br />waited thirty (30) days, Mr. Harmon would have lost his eligibility for membership in <br />PERF. <br />- Approve Resolution No. 82 -2010 — Reorganization of the Ranks of the South Bend Fire <br />Department <br />Mr. Bodnar stated that this reorganization will eliminate the rank of Engineer effective <br />January 1, 2011, and replace it with the rank of Firefighter 1St Class. He noted the salaries <br />are the same; there is no change other than rank. <br />- Approve Contract with Memorial Hospital for Ambulance Staffing <br />Mr. Bodnar informed the Board this will be a two (2) year contract, effective 2011 and <br />2012. <br />Resolution No. 80 -2010 — Establishing the 2011 Holiday Schedule for the South Bend Fire <br />Department <br />Mr. Bodnar stated this schedule is the same as 2010, except Veteran's Day has been <br />added as a critical duty day. Officers on duty that day will receive time and a half pay. <br />ADJOURNMENT <br />There being no further business to come before the Board, President Dempsey declared the <br />meeting adjourned at 8:25 a.m. <br />
