South Side Development Area <br />(1) continued... <br />Upon a motion by Mr. Downes, seconded by <br />Mr. Varner and unanimously carried, the <br />Commission approved Resolution No. 2802 <br />approving and authorizing the execution of <br />an Addendum to the Master Agency <br />Agreement (4215 S. Main St., Demolition <br />Planning Project) <br />(2) Proposal for professional services related <br />to property acquisition assistance (748 <br />Hawbaker Street). <br />Mr. Relos noted that the initial plan <br />regarding the retention ponds near Ireland <br />and Miami was to reconfigure them. During <br />that time we intended to acquire 748 <br />Hawbaker to help with the reroute of pipe <br />work along High Street. The owner was <br />uncooperative in providing documentation so <br />we could get clean title to the property. <br />Negotiations fell apart. Chris Davey of <br />Grubb & Ellis offered to acquire the property <br />and then do a land swap with the city for a <br />more developable property. Mr. Davey put <br />up a $2,000 non - refundable deposit on the <br />748 Hawbaker property. When the city <br />decided to simply clean up the existing <br />ponds, it did not need to acquire the property <br />on Hawbaker and Mr. Davey was left <br />holding this unneeded property. Staff <br />recommends reimbursing Mr. Davey for his <br />out -of- pocket costs. <br />Ms. King said she noticed that at the Miami <br />Street retention pond they have taken down <br />all the fencing and all the trees.
