Dieter <br /> Member of the Common Council <br /> <br />Councilmember Kirsits, Chairperson, Zoning and Annexation Committee reported that <br />this committee held a Public Hearing on this bill this afternoon and sends it to the full <br />Council with a favorable recommendation. <br /> <br />Mr. Mark Lyons, Assistant Building Commissioner, Building Department, 125 S. <br />Lafayette Boulevard, South Bend, Indiana, presented the report from the Area Board of <br />Zoning Appeals. <br /> <br />Mr. Lyons advised that the Area Board of Zoning Appeals held a public hearing on July <br />7, 2010 and sends this bill to the Common Council with a favorable recommendation. <br /> <br />Mr. Paul Phair, Holladay Properties, 227 South Main Street, Suite 300, South Bend, <br />Indiana, made the presentation on this bill. <br /> <br />Mr. Phair advised that the purpose of this special exception is to allow use of Recreation <br />for a Gymnastics Studio in an existing light industrial zoning and to reduce the required <br />number of parking from 640 spaces to 40 spaces for this use. Mr. Phar stated that most <br />operations in this area take place between the hours of 7 a.m. and 5 p.m. and the <br />gymnastics operation will have their heaviest use in the evening between the hours of 5 <br />p.m. and 9 p.m., so the possible interaction of this group with others in the area is very <br />minimal. Mr. Phair noted that the reduction of parking spaces will not cause any undue <br />harm to public health, safety, morals, or general welfare. He stated that currently Elite <br />Sports only has 5 employees, and there are only 2 or 3 gymnasts who are old enough to <br />drive themselves to practice. Most of the traffic is for pick-up and drop-off of the <br />gymnasts. <br /> <br />A Public Hearing was held on the Resolution at this time. <br /> <br />There being no one present wishing to speak to the Council either in favor of or in <br />opposition to this Resolution, Councilmember Varner made a motion to adopt this <br />Resolution.
