264 REGULAR MEETING NOVEMBER 26. 1979 PIGEON CONTROL PROPOSAL - ACCEPTED Mr. McMahon noted that the Board had requested proposals for pigeon control on River Bend Plaza and Pier Park for one year, from December 1, 1979 through November 30, 1980. The following proposals were received: Arrow Services, Inc. Franklin Pest Control Pritchard Services Indiana Terminix Co. $75.00 first service $75.00 per month Total - $900.00 $52.00 per month Total - $624.00 $495.00 initial cost $95.00 per ,month Total - $1635.00 $95.00 initial service $50.00 per month Total - $645.00 Paid -in- Advance Discount $612.75 Upon motion made by Mr. McMahon, seconded by Mr. Mullen and carried, the proposal of Indiana Terminix Co. of $612.75 was accepted and referred to the Controller's Office and River Bend Plaza for implementation of the service. DENIAL OF TAXI LICENSE - DENNIS BANICKI Peter H. Mullen reported to the Board that he concurred with the recommendation of the Police Department that the taxi license application of Dennis Banicki should be denied, based on the fact that he lied on his application and did not include the fact that he was arrested for possession of a controlled substance and delivery of a controlled substance, that he was convicted and received eighteen months probation. Upon motion made by Mr. McMahon, seconded by Mr. Brunner and carried, with Mr. Mullen abstaining, the recommendation was approved and the taxi license denied. The applicant is to be notified of his right to a hearing on the matter before the Board. APPROVAL OF INSTALLATION OF LIGHTS ON RIGHT -OF -WAY The Board received a request from Caparell`s Cafe, 3421- West Sample Street, to install lights in the right -of -way on the Falcon Street side of the restaurant. An insurance certificate will be furnished to hold the City harmless. The Bureau of Traffic and Lighting reviewed the request and has no objection with the understanding that the luminaires shall contain no larger than 100 watt incandescent bulbs, that neither the City of South Bend nor Indiana and Michigan Electric Company shall maintain, repair, replace or supply power to the lights and that after installation if modifications are needed for public works improvements or to insure safety for vehicular and pedestrian traffic they will be made at the owner's expense. Upon motion made by Mr. McMahon,., seconded by Mr. Mullen and carried, the request was approved subject to the stipulations as noted. n
