192 <br />REGULAR MEETING <br />SEPTEMBER 17, 1979 <br />A regular meeting of the Board of Public Works was convened at <br />9:30 a.m. on Tuesday, September 17, 1979 by President Patrick <br />M. McMahon, with Mr. McMahon, Mr. Brunner and Mr. Mullen present. <br />Deputy City Attorney Terry A. Crone was also present. <br />OPENING OF BIDS - INDIANA AVENUE IMPROVEMENTS <br />This was the date set for receiving bids for curb and sidewalk <br />improvements and radius improvements on Indiana Avenue. The Clerk <br />tendered proofs of publication of notice in the South Bend <br />Tribune and the Tri- County News which were found to be sufficient. <br />The following bids were opened and publicly read: <br />Ziolkowski Construction Company Bid was signed by Ben Ziolkowski, <br />South Bend, Indiana non - collusion affidavit was in <br />order and a 5% bid bond was <br />submitted. <br />Bid - $59,227.90 <br />Rieth Riley Construction Company Bid was signed by Chester <br />South Bend, Indiana Skwarcan, non - collusion affida- <br />vit was in order and a 5% bid <br />bond was submitted. <br />Bid - $53,772.00 <br />Murdock & Sons Construction <br />South Bend, Indiana <br />Bid - $50,000.00 <br />McIntyre & Jones Construction Co. <br />Mishawaka, Indiana <br />Bid - $57,855.40 <br />Bid was signed by Calvin <br />Murdock, non- collusion affida- <br />vit was in order and a 5% bid <br />bond was submitted. <br />Bid was signed by Kenneth A. <br />McIntyre, non - collusion affidavit <br />was in order and a 5% bid bond <br />was submitted. <br />Mr. McMahon made a motion to refer the bids to the Division of <br />Engineering for review and recommendation. Mr. Brunner seconded <br />the motion and it carried. Mr. Murdock was present and asked if <br />the completion date would have,an effect on the contract award. <br />Mr. McMahon then noted the foilowing'completion dates listed on <br />the bids: Ziolkowski Construction Company - 60 days; Rieth- <br />Riley Construction Co. - December 15, 1979; Murdock & Sons - <br />May 15, 1980 and McIntyre and Jones - June 30, 1970. Mr. McMahon <br />said the completion date could be-a factor in making the award <br />and that would be considered in the review of the bids. <br />VACATION RESOLUTION NO. 3478 CONFIRMED <br />This being the date set, hearing was held on Vacation Resolution <br />No. 3478 for the vacation of the first alley north of Huron <br />Street, running east and west from Grant Street to Brookfield <br />Street, excepting therefrom the 14' right o-f-way of the north -south <br />alley. The petition was submitted by Cecylia Grybowich, L. E. <br />Weissfuss, B. E. Hoffman and Alice Klosowski, abutting property <br />owners. Ted Kazmierczak spoke in favor of the vacation and said <br />there are a number of children who play in the alley and the <br />petitioners feel it should be closed. Mrs. Grybowich spoke in <br />favor of the closing. There were no remonstrators present and no <br />written remonstrances were filed with the Board. Upon motion made <br />by Mr. McMahon, seconded by Mr. Mullen and carried, the Board <br />confirmed the Vacation Resolution and directed that an Assessment <br />Roll be prepared. <br />r <br />L <br />
