181 <br />REGULAR MEETING <br />SEPTEMBER 4. 1979 <br />A regular meeting of the Board of Public Works was convened <br />at 9:30 a.m. on Tuesday, September 4, 1979 by President <br />Patrick McMahon, with Mr. McMahon, Mr. Brunner and Mr. <br />Mullen present. Deputy City Attorney Terry A. Crone was also <br />present. <br />MINUTES OF AUGUST 27 MEETING APPROVED <br />Mr. Mullen reported that the minutes of the August 27 meeting had <br />been reviewed and he made a motion that they be approved. Mr, <br />McMahon seconded the motion and it carried. <br />IMPROVEMENT RESOLUTION NO. 3477 RESCINDED <br />This was the date set for holding a public hearing on Improvement <br />Resolution No. 3477, 1979 for the construction of a concrete <br />pavement on the north -south alley between Parkview Place and <br />Riverside Drive, from Woodlawn to Oakwood. The Clerk tendered proofs <br />of publication of notice in the South Bend Tribune and the Tri- County <br />News which were found to be sufficient. Mr, McMahon noted that this <br />resolution was initiated upon the petition of an affected property <br />owner for the paving of the alley under Barrett Law. He then <br />reported receipt by the Board of a petition signed by twenty -six <br />property owners remonstrating against the project and a petition <br />signed by Robert Pinkowski in favor of the project. The Assessment <br />Roll lists thirty -seven affected property owners and, therefore, the <br />remonstrance petition submitted represents more than fifty -one per <br />cent of the affected owners. Both petitions were filed. Mr. McMahon <br />made a motion to rescind Improvement Resolution No. 3477, subject to <br />verification of the signatures on the remonstrance petition by the <br />Engineering Department. Mr. Mullen seconded the motion and it carried. <br />The Board was asked what recourse a property owner has if he is <br />interested in seeing the alley paved. Mr. McMahon responded that <br />the work would have to be done privately. The question was raised <br />if this matter could be brought up every two years as it was voted <br />down by property owners two years ago. Mr. McMahon noted that any <br />property owner can petition the Board for such a project and that <br />would initate the process. <br />OPENING OF BIDS - POLICE RADIOS <br />This was the date set for receiving bids for ten portable radios, <br />batteries and chargers for the Police Department. The Clerk <br />tendered proofs of publication of notice in the South Bend Tribune <br />and the Tri - County News which were found to be sufficient. The <br />following bids were opened and publicly read: <br />General Electric Company Bid was signed by Andrew T. Campos, <br />non- collusion affidavit was in order <br />and a 10% bid bond was submitted. <br />Bid,'�­ 10 Portable Radios $918.50 <br />10 700 mah Batteries 31.50 <br />10 chargers 31.50 <br />Total $981.50 $9,815.00 <br />Upon motion made by Mr. McMahon, seconded by Mr. Mullen and carried, <br />the bid was referred to the Police Department and Communications <br />Department for review and recommendation. <br />
