M M Uj Q Q 135 REGULAR 14EETING JULY 23, 1979 OPENING OF BIDS - MODIFICATION AND ADDITION TO WALK -IN COOLER AND FREEZER AT CENTURY CENTER This was the date set for receiving bids for an addition and modifications to the talk -in Cooler and Freezer at Century Center. The Clerk tendered proofs of publication of notice in the South Bend Tribune and the Tri- County News which were found to be sufficient. The following bids were opened and publicly read- Harry W. Johnson Company Bid was signed by Harry W. Johnson, Bluffton, Indiana non- collusion affidavit was in order and a bid bond was submitted. Bid - $14,239.00 Upon motion made by Mr, McMahon, seconded by Mr. Mullen and carried, the bid was referred to Brian Hedman, Executive Director of Century Center, for review and recommendation. PUBLIC HEARING ON ASSESSMENT ROLL - VACATION RESOLUTION NO. 3474 PROCEEDINGS CLOSED This being the date set, hearing was held on the Assessment Roll with respect to Vacation Resolution No. 3474 for the vacation of the 14' alley which abuts the north side of the Cathedral of St. James and runs east and west from Lafayette Blvd. to St. James Court. The Clerk tendered proofs of publication of notice in the South Bend Tribune and the Tri - County News which were found to be sufficient. There was no one present to speak on the Assessment Roll and no written remonstrances were filed with the Board. Upon motion made by Mr. McMahon, seconded by Mr, Mullen and carried, the Assessment Roll showing $0.00 net benefits and $0.00 net damages was approved and said resolution is in all things ratified and confirmed and said proceedings closed. ADOPTION OF VACATION RESOLUTION NO. 3476 The petition of the Gospel Center Church to vacate the first alley south of Mishawaka Avenue, running east and west between 30th and 31st Streets, was reviewed by the Engineering Department, Area Plan Commission and the Community Development Department. The Board received favorable reports from each department. Upon motion made by Mr. McMahon, seconded by Mr. Mullen and carried, the reports were filed and the following resolution was adopted: VACATION RESOLUTION NO. 3476 RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, That it is desirable to vacate the following: the first alley south of Mishawaka Avenue running east and west between 30th and 31st Streets excepting therefrom the 16' right -of -way of the north -south alley intersection Reserving the rights and easements of all Utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right of way, unless such rights are released by the individual Utilities.
