M <br />M <br />Uj <br />Q <br />Q <br />135 <br />REGULAR 14EETING <br />JULY 23, 1979 <br />OPENING OF BIDS - MODIFICATION AND ADDITION TO WALK -IN COOLER <br />AND FREEZER AT CENTURY CENTER <br />This was the date set for receiving bids for an addition and <br />modifications to the talk -in Cooler and Freezer at Century <br />Center. The Clerk tendered proofs of publication of notice in <br />the South Bend Tribune and the Tri- County News which were found <br />to be sufficient. The following bids were opened and publicly <br />read- <br />Harry W. Johnson Company Bid was signed by Harry W. Johnson, <br />Bluffton, Indiana non- collusion affidavit was in <br />order and a bid bond was submitted. <br />Bid - $14,239.00 <br />Upon motion made by Mr, McMahon, seconded by Mr. Mullen and <br />carried, the bid was referred to Brian Hedman, Executive Director <br />of Century Center, for review and recommendation. <br />PUBLIC HEARING ON ASSESSMENT ROLL - VACATION RESOLUTION NO. 3474 <br />PROCEEDINGS CLOSED <br />This being the date set, hearing was held on the Assessment Roll <br />with respect to Vacation Resolution No. 3474 for the vacation of <br />the 14' alley which abuts the north side of the Cathedral of St. <br />James and runs east and west from Lafayette Blvd. to St. James <br />Court. The Clerk tendered proofs of publication of notice in the <br />South Bend Tribune and the Tri - County News which were found to be <br />sufficient. There was no one present to speak on the Assessment <br />Roll and no written remonstrances were filed with the Board. Upon <br />motion made by Mr. McMahon, seconded by Mr, Mullen and carried, the <br />Assessment Roll showing $0.00 net benefits and $0.00 net damages <br />was approved and said resolution is in all things ratified and <br />confirmed and said proceedings closed. <br />ADOPTION OF VACATION RESOLUTION NO. 3476 <br />The petition of the Gospel Center Church to vacate the first alley <br />south of Mishawaka Avenue, running east and west between 30th and <br />31st Streets, was reviewed by the Engineering Department, Area <br />Plan Commission and the Community Development Department. The <br />Board received favorable reports from each department. Upon motion <br />made by Mr. McMahon, seconded by Mr. Mullen and carried, the reports <br />were filed and the following resolution was adopted: <br />VACATION RESOLUTION NO. 3476 <br />RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, <br />INDIANA, That it is desirable to vacate the following: <br />the first alley south of Mishawaka Avenue running east <br />and west between 30th and 31st Streets excepting therefrom <br />the 16' right -of -way of the north -south alley intersection <br />Reserving the rights and easements of all Utilities and the Municipal <br />City of South Bend, Indiana, to construct and maintain any facilities, <br />including, but not limited to, the following: electric, telephone, <br />gas, water, sewer, surface water control structures and ditches, within <br />the vacated right of way, unless such rights are released by the <br />individual Utilities. <br />
