REGULAR MEETING September 6, 19 October 3, 17, 31 November 14, 28 December 5, 12, 27 APPROVAL OF PROCESSION The following procession was presented for approval: NOVEMBER 8, 2010 349 Applicant Description Date/Time Location Motion Carried Erskine Boulevard Procession; December 11, Erskine Blvd. from Inks /Littrell Association 26th Annual 2010; 6:00 p.m. Ewing St. to Donmoyer Erskine to 9:00 P.M. Ave. Boulevard Candlelight Walk FAVORABLE RECOMMENDATION - PETITION TO VACATE THE NORTH HALF OF THE FIRST NORTH /SOUTH ALLEY WEST OF WALNUT STREET BETWEEN DUNHAM STREET AND FISHER STREET Mr. Gilot indicated that Juanita and Lucio Cantu, 1336 West Dunham Street, South Bend, Indiana 46619, has submitted a request to vacate the above referenced alley. Mr. Gilot advised the Board is in receipt of favorable recommendations concerning this Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Community & Economic Development and Engineering. Area Plan stated the vacation would not hinder the growth or orderly development of the unit or neighborhood in which it is located or to which it is contiguous. The vacation would not make access to the lands of the aggrieved person by means of public way difficult or inconvenient. The vacation would not hinder the public's access to a church, school or other public building or place. The vacation would not hinder the use of a public right- of-way by the neighborhood in which it is located or to which it is contiguous. Therefore, Mr. Littrell made a motion that the Clerk send a letter to the petitioner of favorable recommendation for the vacation. Mr. Inks seconded the motion which carried. FAVORABLE RECOMMENDATION - PETITION TO VACATE THE NORTH /SOUTH ALLEY FROM BRYAN STREET NORTH TO THE EAST /WEST ALLEY EAST OF INGLEWOOD STREET AND WEST OF SHERMAN AVENUE Mr. Gilot indicated that Willie Rogers, 1033 West Bryan Street, South Bend, Indiana 46616, has submitted a request to vacate the above referenced alley. Mr. Gilot advised the Board is in receipt of favorable recommendations concerning this Vacation Petition from the Area Plan Commission, Police Department, Community & Economic Development and Engineering. Area Plan stated the vacation would not hinder the growth or orderly development of the unit or neighborhood in which it is located or to which it is contiguous. The vacation would not make access to the lands of the aggrieved person by means of public way difficult or inconvenient. The vacation would not hinder the public's access to a church, school or other public building or place. The vacation would not hinder the use of a public right -of -way by the neighborhood in which it is located or to which it is contiguous. Engineering stated the petitioner needs to be in agreement with the neighbors on the placement of a fence, and will need to close the curb and sidewalk across the approach. Therefore, Mr. Gilot made a motion that the Clerk send a letter to the petitioner of favorable recommendation regarding this vacation, subject to the noted issues being addressed. Mr. Littrell seconded the motion which carried.
