Jefferson Blvd. South Bend, IN 46601 RELEASE OF REHABILITATION AGREEMENT For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the Redevelopment Commission of the City of South Bend, Indiana, acting for and on behalf of the Bureau of Housing, does forever hereby release and discharge from the real property located at 422 N. College Street, South Bend, Indiana, situated in St. Joseph County, Indiana and more particularly described as follows: Lots Numbered One Hundred Twenty Three (123) and One Hundred Twenty Four (124) as shown on the recorded Plat of Raff, Sibley and Fassnacht's Linden Place Addition to the City of South Bend, Indiana, recorded May 26, 1891, in the Office of the Recorder of St. Joseph County, Indiana, in Plat Book 5 Page 51 the terms, conditions and provisions of the Federal Rental Rehabilitation Loan Agreement (the "Agreement ") dated January 25, 1991, between the Housing Development Corporation of St. Joseph County, (the "Owner ") and the Redevelopment Commission of the City of South Bend, Indiana, acting for and on behalf of the Bureau of Housing, (the "Commission ") recorded February 20, 1991, in the Office of the Recorder of St. Joseph County, Indiana, in Instrument No. 9104041. This document shall constitute a full release of the Agreement concerning the above - described real estate and no rights whatsoever are intended to remain in the Commission. The undersigned persons executing this Release of Rehabilitation Agreement on behalf of the Commission represent and certify that each is the authorized representative of the Commission and has been fully empowered by a proper meeting and vote of the Commission to execute and deliver this document and in doing so is not violating any other agreement for which either is a party; that the Commission has full legal capacity to release the Agreement and that all action necessary to authorize the release of the Agreement on the Commission's behalf has been duly taken.
