GIBNEY <br />EXECUTIVE DIRECTOR <br />October 4, 2010 <br />Council Member Timothy Rouse, Chairperson <br />Community & Economic Development Committee <br />South Bend Common Council <br />4th Floor, County City Building <br />South Bend, IN 46601 <br />RE: Residential Real Property Tax Abatement for: <br />Kendall-Weiss, LLP <br />Dear Council Member Rouse: <br />On September 24, 2007, through Resolution Number 3788-07, the Common Council <br />approved a Residentially Distressed Area (RDA) for Kendall-Weiss, LLP for residential <br />tax abatement. The RDA contained nine parcels. The parcels were commonly known as <br />219, 222, 224, 228 and 231 South Notre Dame Avenue and 827 East Wayne Street plus <br />three vacant lots that did not have street addresses. The parcels had the following tax key <br />numbers: 18-6003-0069, 18-6007-0169, 18-6007-0170, 18-6007-0172, 18-6003-0074, <br />18-6003-0075, 18-6003-0070, 18-6003-0071 and 18-6007-0171. After the Confirming <br />Resolution was approved the parcels inside the RDA were replatted. Although the <br />boundaries of the RDA were not changed, the boundaries of the parcels inside of it were <br />reconfigured and the number of parcels was reduced to seven. Also, new legal <br />descriptions, tax key numbers, and street addresses were adopted. This has led to <br />confusion as potential buyers have come in to apply for tax abatements on the parcel they <br />wish to purchase.
