L A- <br />Substitute Bill No. 30 -10 <br />Ordinance No. <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, AMENDING VARIOUS SECTIONS OF ARTICLE 9, OF CHAPTER 2 OF <br />THE SOUTH BEND MUNICIPAL CODE ADDRESSING THE HUMAN RIGHTS <br />ORDINANCE BY THE INCLUSIONS OF NEW PROVISIONS ADDRESSING <br />EMPLOYMENT FAIRNESS <br />STATEMENT OF PURPOSE AND INTENT <br />The City of South Bend, Indiana, has long been a respected leader in the area of <br />municipal legislation in the State of Indiana, and thus, it has been determined that the current <br />South Bend Human Rights Ordinance should be amended to prohibit employment discrimination <br />based on sexual orientation or gender identity, and to provide remedies for such discrimination <br />occurring within the city limits. <br />Presently, under Mayor Stephen J. Luecke's Executive Order issued in 2009, persons <br />employed by City of South Bend are protected from job discrimination due to sexual orientation, <br />gender identity, and persons employed by the State of Indiana enjoy similar rights under <br />Governor issued Executive Orders. It is fair, reasonable, and appropriate that citizens of South <br />Bend who work for other employers within the City receive the same protection. South Bend is <br />committed to the principle that all persons within this City be recruited, hired, developed, <br />promoted, and treated as employees on the basis of individual merit and ability. To achieve this <br />objective, by guaranteeing the right of nondiscrimination in employment without reference to a <br />person's sexual orientation and/or gender identity, it is necessary to amend South Bend's Human <br />Rights Ordinance. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE <br />CITY OF SOUTH BEND, INDIANA, as follows: <br />Section I. Chapter 2, Article 9 of the South Bend Municipal Code shall be amended to <br />read in its entirety as follows: <br />ARTICLE 9. HUMAN RIGHTS ORDINANCE. <br />Sec. 2 -126. Short Title. <br />This article shall be known as the South Bend Human Rights Ordinance. <br />Sec. 2 -127. Purpose. <br />(a) It is the public policy of the City of South Bend to provide all of its citizens equal <br />opportunity for education, employment, access to public conveniences and accommodations, and <br />
