~~ ~ .~~~~ <br />~~, <br />``~'#~- M ZONING & ANNEXATION COMMITTEE June 28, 2010 <br />The June 28, 2010 meeting of the Zoning and Annexation Committee of the South Bend <br />Common Council was called to order by its Chairperson Council Member AI "Buddy" Kirsits at <br />4:00 p.m., in the Informal Meeting Room, 4~" Floor County-City Building, 227 W. Jefferson Blvd., <br />South Bend, Indiana <br />Committee Members Present: Tom LaFountain, Oliver Davis, David Varner <br />Other Council Present: Ann Puzzello, Karen White, Tim Rouse, Henry Davis, Jr. <br />Others Present: Rita Kopala, Mark Lyons, Gregg Zientara, Ron Berkheiser, <br />Elizabeth Parvu, Jeff Vitton Jack Dillon, Tom Price, Jeff Parrott, <br />Mayor Luecke, Marti Wolfson, Gary Gilot, Aladean DeRose <br />Agenda: Bill No. 10-32 -Annexation Center Twp. <br />Bill No. 23-10 -Annexation Centre Twp. <br />Bill No. 10-30 -Special Exception - 2211 S. Michigan <br />Bill No. 10-32 & Bill No. 23-10 -Annexation Centre Twp. <br />Chairperson Kirsits with a full committee present began the hearing by announcing both bills <br />relative to the Berkheiser annexation would be heard jointly. The property in question is a small <br />.2169 acre residential property with no proposed use change. The reason for the voluntary <br />annexation was to allow connection to the city sewer system. Anew septic system was both <br />problematic and too expensive. Jeff Vitton explained the city support from his economic <br />development planner by state law included an analysis of the fiscal impact of the annexation. He <br />estimated a five year cost to the city of $6500 with a return of at least $6750 over the same <br />period. Also reported was the okay from effected departments. The petitioner was present for <br />questions but there were none. Calling the question, Chairperson Kirsits, accepted a motion from <br />Councilmember Varner, seconded by Councilmember Oliver Davis that Bill No. 23-10 to the full <br />Council favorably. All supported. Additionally, Councilmember LaFountain moved Bill No. 10-32 <br />go to Council favorably as well. Councilmember Oliver Davis seconded and all concurred. <br />Bill No. 10-30 -Special Exception - 2211 S. Michigan <br />This bill would allow a special exception for a pastry decoration shop offering classes at 2211 S. <br />Michigan. The exception was required in a MU mixed use district. Mark Lyons, of the Building <br />Department reported the hearing before the BZA resulted in a unanimously favorable <br />recommendation without any objectors or reservation. The petitioner Elizabeth Parvu was <br />available for questions, but there were none. On a motion by Councilmember Varner seconded <br />by Councilmember Oliver Davis, supported by all the bill went to Council favorably. <br />There being no further business to come before the Committee at this time.
