L,UECKE, .MAYOR <br />OFFICE OF THE MAYOR <br />Mr. Derek Dieter <br />President, South Bend Common Council <br />4th Floor, county -City Building <br />South Bend, Indiana 46601 <br />Re: Bill 25 -10 Tax abatement — Second Substitute Version <br />Dear President Deiter: <br />October 5, 2010 <br />Attached is the second substitute version of Bill 25 -10 which is an Ordinance <br />proposing significant changes to South Bend's tax abatement process. <br />The first substitute version was submitted solely for typographical and other <br />cosmetic changes. No substantive amendments were made. <br />This second substitute version does not make any substantive amendments. It <br />addresses issues raised in the Technical Review from the City's Economic Development <br />Division and in the legal memorandum from Council Attorney Kathy Cekanski- Ferrand, <br />Various amendments have been made to clarify several clause, sub - sections and <br />paragraphs throughout the document. The most significant amendments are listed below: <br />1. Sec.2 -76.1 (a) (12) — A explanation was added on how to determine which <br />census tracts should be included in the Economically Distressed Area after each <br />decennial census is completed, and it was noted that a map of the Economically <br />Distressed Area is available in the City Clerk's Office and on the City of South Bend's <br />website; <br />2. Sec. 2 -76.1 (a) (17) — The number of activities that can be included under <br />"Institutional development" was expanded to include medical or governmental facilities <br />that are both privately owned and taxable; <br />3.
