REGULAR MEETING AUGUST 9, 2010 <br /> <br /> <br /> <br />Mishawaka Avenue is primarily a business and commercial area which includes a piano <br />repair and resale ship, clothing and gift store, a printing service, a soft water company, <br />and a hair salon. A single family residential neighborhood is located to the north. The <br />most desirable use of the property is local commercial, retail service or residential. Any <br />of these uses are compatible with the adjacent mixed uses located along both Mishawaka <br />Avenue and Longfellow Avenue. Surrounding property values should not be negatively <br />affected since the proposed rezoning is to a less intense district. Residential use of the <br />property is compatible with the adjacent commercial, retail and residential uses. The <br />proposed use is responsible growth and development since it lies within a mixed use area <br />which includes commercial, retail, and residential uses. Mr. Spier noted that the <br />Commission held a public hearing on July 20, 2010 and sends this bill to the Common <br />Council with a favorable recommendation. He stated that based on information available <br />prior to the public hearing the Staff recommends that the petition be sent to the Council <br />with a favorable recommendation. Mr. Spier advised that this rezoning will allow for an <br />existing vacant commercial structure to be rehabilitated and used for single-family <br />residence. Residential use of the site is compatible with the adjacent mixed land uses <br />including commercial, retail, service, and residential. <br /> <br />Mr. Michael Wiescher, 1007 Hudson Avenue, South Bend, Indiana, made the <br />presentation for this bill. <br /> <br />Mr. Wiescher advised that he is requesting a zone change from MU Mixed Use District to <br />SF 2 Single Family & Two Family District to allow for a private, loft-style residence. He <br />stated that he would like to restore the building to its original design, maintaining its <br />commercial appearance and convert the interior of the building to a loft style two person <br />residence. <br /> <br />This being the time heretofore set for the Public Hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. <br /> <br />Councilmember Rouse questioned if this rezoning this from commercial to residential <br />would lower the property’s assessed value. <br /> <br />Council President Derek Dieter called upon City Clerk John Voorde, former Portage <br />Township Assessor. <br /> <br />City Clerk Voorde stated that depending on how it is assessed the value could go down or <br />up. He noted that if it is assessed commercial, it might qualify for some economic or <br />functional obsolescence causing the value to go down, if it is assessed residentially with <br />the property tax caps in place the value could go up. He stated that it would first have to <br />be determined how the property is assessed. <br /> <br />There being no one present wishing to speak to the Council either in favor of or in <br />opposition to this bill, Councilmember Dieter made a motion for favorable <br />recommendation to full Council concerning this bill as substituted.
