ORDINANCE NO. 1 13 `OHO <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, ANNEXING TO AND BRINGING WITHIN THE <br />CITY LIMITS OF SOUTH BEND, INDIANA, AND AMENDING THE ZONING <br />ORDINANCE FOR CERTAIN PROPERTY GENERALLY LOCATED <br />EAST OF EDDY STREET, WEST OF IVY ROAD AND SOUTH OF (AND INCLUDING) <br />EDISON ROAD (AS RE-ALIGNED) IN PORTAGE TOWNSHIP AND CONTIGUOUS <br />THEREWITH COUNCILMANIC DISTRICT N0.4 <br />Name of Petition: UNIVERSITY OF NOTRE DAME DU LAC <br />Common Address: Property generally located East of Eddy Street, West of Ivy <br />Road and South of Edison Road (including roadway right- <br />of-ways) <br />STATEMENT OF PURPOSE AND INTENT <br />A Petition for the voluntary annexation and for the zoning of approximately 26.20 <br />acres located in Portage Township, St. Joseph County, Indiana, has been filed by 100% of the <br />owners of the land in the territory sought to be annexed. It is the intent and purpose of this <br />Ordinance to annex this temtory to the City of South Bend, Indiana, and to establish a zoning <br />district for this territory. <br />NOW THEREFORE BE IT ORDAINED by the Common Council of the City of <br />South Bend, Indiana as follows: <br />SECTION I. That the following described real estate situated in St. Joseph County, Indiana, <br />being contiguous by more than one-eighth (1/8) of its aggregate external boundaries with the <br />present boundaries of the City of South Bend, Indiana, shall be and hereby is annexed to and <br />brought within the City of South Bend: <br />A PART OF THE SOUTHEAST AND SOUTHWEST QUARTERS OF SECTION 31, TOWNSHIP <br />38 NORTH, RANGE 3 EAST, CLAY TOWNSHIP, AND A PART OF THE NORTHEAST AND <br />NORTHWEST QUARTERS OF SECTION 6, TOWNSHIP 37 NORTH, RANGE 3 EAST, <br />PORTAGE TOWNSHIP, ALL IN ST. JOSEPH COUNTY, INDIANA AND BEING MORE <br />PARTICULARLY DESCRIBED AS: BEGINNING AT A POINT OF INTERSECTION OF THE <br />SOUTH LINE OF SAID SECTION 31 AND THE EAST RIGHT-OF-WAY LINE OF IVY ROAD <br />EXTENDED SOUTH; THENCE NORTH ALONG SAID EXTENDED LINE A DISTANCE OF <br />52.20 FEET MORE OR LESS TO A POINT; THENCE WEST A DISTANCE OF 70 FEET MORE <br />OR LESS TO A POINT OF INTERSECTION OF THE WEST RIGHT-OF-WAY LINE OF SAID <br />IVY ROAD WITH THE NORTH RIGHT-OF-WAY LINE OF EDISON ROAD AS SAID NORTH <br />LINE IS SHOWN ON A SET OF EDISON ROAD RE-ALIGNMENT ROAD PLANS PREPARED <br />
