ORDINANCE NO. ~ ~ ~~ ` ~~° AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 2, ARTICLE 14 OF THE SOUTH BEND MUNICIPAL CODE TO ADD A NEW SECTION 2-170.9 ESTABLISHING ANON- REVERTING "PALAIS ROYALS HISTORIC PRESERVATION FUND." STATEMENT OF PURPOSE AND INTENT The Common Council has determined that it is in the City's best interest to create a fund for continuing historic preservation, maintenance, and repair of the Palais Royale, a historic landmark in downtown South Bend listed since 1984 on the National Register of Historic Places, and contiguous to the Morris Performing Arts Center. To enable continued historic preservation of the Palais Royale Building it is appropriate to authorize a 2% charge for all services provided in connection with the use and rental of the Palais Royale facilities, to be deposited in a new, non-reverting fund for this purpose. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA as follows: Section I. Article 2, Chapter 14 of the South Bend Municipal Code shall be amended to add anew Sec. 2-170.9 as follows: Sec. 2-170.9. Palais Royale Historic Preservation Fund (a) The Palais Royale Historic Preservation Fund is established as a separate, non- revertin~fund to receive monies from a 2% charge assessed on all services provided in connection with the use and rental of Palais Royale facilities, and to receive monies from donations to the Palais Royale. All sums so collected and deposited in this fi.~nd shall be used for the sole purpose of assisting with the continued historic preservation maintenance and repair of the Palais Royale building and related facilities. The funds in this account shall not be the sole source of monies for historic Preservation of the Palais Royale, nor shall the existence of this fund preclude the Cit fy rom providing other funds for this purpose. Monies in this fund at the end of the fiscal near shall not revert to the general fund.
