Mr. <br />Dave Rafinski, Wightrnan Petrie, informed the Board that there was a five (5) member panel to <br />evaluate the above proposals. Based on the scoring matrix, it was unanimous that Musco <br />Lighting scored the highest in all categories. Musco scared a total of 441 points, and Gaylor <br />scared a total of 324 points. The matrix was based on cost, energy consumption, service and <br />maintenance, warranty, and experience. Mr. Rafrnski noted that Musco submitted two proposals, <br />and the panel voted to award the more expensive one due to better energy efficiency and tweniy- <br />five year warranty versus a ten year warranty. He stated that in their proposal, Musco guaranteed <br />their lighting would maintain minimum lighting requirement. The warranty, however, read that <br />the lighting could drop or rise ten percent (10%} which is not acceptable to baseball standards. <br />Mr. Rafinski required they send an addendum to their warranty that warrants the lighting will <br />never drop below minimum baseball standards. Mr. Phil Custard, Purchasing, questioned what <br />was to become of the old light poles once they were removed. Mr. Rafinski stated the wording of <br />their agreement states that Musco will demo the existing poles and place them an a site of the <br />City's choosing. Mr. Inks suggested they might be used in another park. After reviewing the <br />proposals, Mr. Schalliol recommended that the Board award the contract to Musco Lighting, 100 <br />ls` Avenue West, Oskaloosa, Iowa 52577, in the amount of $421,500.00, Therefore, Mr. Gilot <br />made a motion that the recommendation be accepted and the proposal be awarded as outlined <br />above. Mr. Inks seconded the motion, which carried. <br />APPROVAL OF RECOMMENDATION TO ENCROACH ONTO PUBLIC RIGHT-OF-WAY <br />- KRG, EDDY COMMONS, LLC <br />Mr. Gilot advised that the Board is in receipt of a request from Kite Realty to build a permanent <br />outdoor seating area at 1234 N. Eddy St., Ste. 125, Eddy Commons, South Bend, Indiana. The <br />request received favorable recommendations from the Division of Engineering, Building <br />Department, Community and Economic Development, and Downtown South Bend. Board <br />Attorney, Cheryl Greene, noted the Board should have wording in the agreement addressing the <br />possibility of a change of ownership and who will pay to have the encroachment removed if that <br />becomes necessary, and the requirement that the encroachment is to stay as is, with no <br />expansion. Mr. Inks noted there will be three parking spaces lost. Mr. Gilot stated that the light <br />pole should stay where it is, but the applicant wi11 need to relocate the bike rack, trash receptacle, <br />and trench drain. Mr. Gilot noted this potential business was requesting a view of the Notre <br />Dame Campus and this was their solution. Mr. Inks added that Kite Realty, the owner of the <br />property, will be paying for the construction costs. Mr. Gilot suggested the Board should require <br />Kite Realty to work with the City Engineer on placement of the bike racks and trash receptacles. <br />
