REGULAR MEETING JUNE 14, 2010

This being the time heretofore set for the Public Hearing on the above bill, proponents
and opponents were given an opportunity to be heard.

Councilmember Henry Davis asked Mr. Spier if in his professional opinion he has seen a
trend in rezoning homes like this from residential to commercial and back again to
residential and if rezoning property like this would be happening in the future.

Mr. Spier stated that they haven’t seen many like this in the downtown area. Mr. Spier
stated that few years ago when the Zoning Ordinance was redone large sections of this
area were rezoned Mixed Use and that use does not allow for single family. He stated
that because the nature of that area was housing attorney’s offices and insurance agents
and things of that nature it was rezoned for mixed use. Now those businesses are moving
out and uses for single family are being sought. He noted that this particular property
was used as an attorney’s office. He stated that it would be hard to tell if in the future
this might be the trend, and believed that it would be a case by case basis.

There being no one present wishing to speak to the Council either in favor of or in
opposition to this bill, Council President Dieter made a motion for favorable
recommendation to full Council concerning this bill as substituted. Councilmember
Kirsits seconded the motion which carried by a voice vote of eight (8) ayes.

RISE AND REPORT
Councilmember Oliver Davis made a motion to rise and report to the full Council.
Councilmember Varner seconded the motion which carried by a voice vote of nine (9)
ayes.

ATTEST: ATTEST:

_________________________ _________________________
John Voorde, City Clerk Ann Puzzello, Chairperson
Committee of the Whole

REGULAR MEETING RECONVENED
Be it remembered that the Common Council of the City of South Bend reconvened in the
Council Chambers on the fourth floor of the County-City Building at 7:20 p.m. President
Derek D.
