~'~ i 3',.3.. <br />EXECUTIVE SESSION <br />OCTOBER 7, 2005 <br />The Board of Public Safety met in the Executive Session at 1:30 p.m. on Friday, October 7, 2005, <br />with Board President Jesusa Rodriguez with Board Members Juanita Dempsey, Wesley Taylor and <br />Donald L. Alford present. Also present were Police Chief Thomas H. Fautz and Board Attorney <br />Thomas Bodnar. <br />The meeting was held in the Mayor=s Conference Room, 14`h Floor, County City Building, South <br />Bend, Indiana, for the purposes specified in I.C. 5-14-1.5-6.1 (b) (2) (B) and (b) (6) (B) and <br />adjourned at 3:25 p.m. <br />SPECIAL MEETING OCTOBER 7, 2005 <br />A special meeting of the Board of Public Safety was convened at 3:32 p.m. on Friday, October 7, <br />2005, by Board President Jesusa Rodriguez with Board Members Juanita Dempsey, Wesley Taylor <br />and Donald L. Alford present. Also present was Board Attorney Thomas Bodnar. <br />DECISION ON HEARING-NATHAN CANNON <br />President Rodriguez advised that this was the date set for the Board=s Public Hearing concerning the <br />matter of Corporal Nathan Cannon of the South Bend Police Department. President Rodriguez <br />acknowledged that the Board was not prepared to make a decision on the matter and asked that the <br />attorneys involved agree to a continuance at a later date to complete witness testimony. Mr. Thomas <br />Bodnar, the attorney for Chief Fautz, stated that he would like to resolve the issue, but if the <br />continuance was in the best interest of the case, he is in agreement. Mr. Jeffrey Kimmel, the attorney <br />for Nathan Cannon, stated that he did not want to continue the matter except for the purpose of <br />additional testimony. Both attorneys agreed on October 20, 2005, at 2:00 p.m. for the date and time <br />for an Executive Session, if that time is acceptable for Mr. Joseph Simeri, the attorney for the Board, <br />in this matter. Upon a motion made by Ms. Dempsey seconded by Mr. Alford and carried, the <br />continuance was accepted and approved. <br />DECISION ON HEARING -RONALD JOHNSON <br />President Rodriguez advised that the board would announce their decision on the above referred to <br />matter at the regular meeting on October 26, 2005. <br />ADJOURNMENT <br />There being no further business to come before the Board, President Rodriguez declared the meeting <br />adjourned at 3:37 p.m. <br />BOARD OF PUBLIC SAFETY <br />AST: ' <br />Angela .
