RESOLUTION NO. A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, ADOPTING A WRITTEN FISCAL PLAN AND ESTABLISHING A POLICY FOR THE PROVISION OF SERVICES TO AN ANNEXATION AREA IN CENTRE TOWNSHIP (BERKHEISER ANNEXATION AREA) WHEREAS, there has been submitted to the Common Council of the City of South Bend, Indiana, an Ordinance and a petition by all (100 %) property owners which proposes the annexation of real estate located in Centre Township, St. Joseph County, Indiana, which is more particularly described at Section 1 of this Resolution; and WHEREAS, the territory proposed to be annexed encompasses approximately .2169 acres of residential property, which property is at least 12.5% contiguous to the current City limits, i.e,, approximately 20% contiguous, generally located at the west side of South Main Street just north of Pulling Street. It is anticipated that the annexation area will remain a single - family residence and utilize city water and sewer services. This site will require a basic level of municipal public services of a non - capital improvement nature, including police and fire protection, street and road maintenance, street sweeping, flushing, snow removal, and sewage collection, as well as services of a capital improvement nature, including street and road construction, sidewalks, street lighting, a sanitary sewer system, a water distribution system, and a storm water system and drainage plan; and WHEREAS, the South Bend Common Council now desires to establish and adopt a fiscal plan and establish a definite policy showing: (1) the cost estimates of services of a non - capital nature, including police and fire protection, street and road maintenance, street sweeping, flushing, and snow removal, and sewage collection, and other non- capital services normally provided within the corporate boundaries; and services of a capital improvement nature including street and road construction, street lighting, a sanitary sewer extension, a water distribution system, and a storm water system to be furnished to the territory to be annexed (2) the method(s) of financing those services; (3) the plan for the organization and extension of those services; (4) that services of a non - capital nature will be provided to the annexed area within one (1) year after the effective date of the annexation, and that they will be provided in a manner equivalent in standard and scope to similar non - capital services provided to areas within the corporate boundaries of the City of South Bend, regardless of similar topography, patterns of land use, and population density; (5) that services of a capital improvement nature will be provided to the annexed area within three (3) years after the effective date of the annexation within the same manner as those services are provided to areas within the corporate boundaries of the City of South Bend regardless of similar topography, patterns of land use, or population density, and in a manner consistent with federal, state and local laws, procedures, and planning criteria; and (6) the plan for hiring the employees or other governmental entities whose jobs will be eliminated by the proposed annexation. WHEREAS, the Board of Public Works of the City of South Bend, and the Board of Public Safety of the City of South Bend, have each approved a written fiscal plan and established a policy for the provision of services to the territory proposed to be annexed, which plan and policy the Common Council finds to be appropriate and in the best interest of the City, and, which it desires to adopt. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section 1. It is in the best interest of the City of South Bend and the area proposed to be annexed that the following described real property located in Centre Township, St. Joseph County, Indiana be annexed to the City of South Bend: Lot 33 & North 30' Lot 34 Gilmers Addition South Michigan Addition Section I1. That it shall be and hereby is now declared and established that it is the policy of the City of South Bend, to furnish to said territory services of a non - capital nature, such as police and fire protection, street and road maintenance, street sweeping, flushing, and snow removal, within one (l) year of the effective date of the annexation in a manner equivalent in standard and scope to services furnished by the City to other areas of the City regardless of similar topography, patterns of land utilization, and population density; and to furnish to said territory, services of a capital improvement nature such as street and road construction, sidewalks, a street light system, a sanitary sewer system, a water distribution system, a storm water system and drainage plan, within three (3) years of the effective date of the annexation in the same manner as those services are provided to areas within the corporate boundaries of the City of South Bend regardless of similar topography, patterns of land use, or population density. Section III. That the South Bend Common Council, shall and does hereby now establish and adopt the Fiscal Plan, attached hereto as Exhibit "A ", and made a part hereof, for the furnishing of said services to the territory to be annexed, which provides, among other things, that the public sanitary sewer and water network is available with capacity sufficient to service this area with all connection and related fees to be paid by the owner in compliance with state and local law; that the road in front of this property is part of the U.S. 31 Realignment Project; that street lights already exist on Main Street; and that no additional public works are contemplated for this annexation area. Section IV. This Resolution shall be effective from and of the date of adoption by the Common Council and approval by the Mayor. INTRODUCTION A. General This Fiscal Plan represents the City of South Bend's (hereinafter, "City ") policy for the annexation of property in Clay Township, St. Joseph County, Indiana (hereinafter, "Annexation Area "), and was developed through the cooperative efforts of the Area Plan Commission and the following City Departments: Legal Department Department of Public Works South Bend Fire Department South Bend Police Department Department of Code Enforcement Department of Community and Economic Development Department of Administration and Finance SECTION II. GENERAL DATA A. Location The Annexation Area is generally located at 60601 S. Main Street, which is on the west side of S. Main Street, north of Pulling and south of Dice Street. The site has single - family home owned by Ms. Louise Berkheiser. Ms. Berkheiser is seeking annexation of her home for the purposes of receiving water and sewer services. See Map 1. B. Legal Description The Annexation Area is lot 33 and North 30' lot 34, Gillmeers South Michigan, Centre Township, St. Joseph County, Indiana. For a complete legal description see Page 15. C. Contiguity The Annexation Area is at least 1/8 (12.5 %) contiguous to the current City limits: Contiguous 70 feet 20% Non - Contiguous 350 feet 80% Total 420 feet 100% D. Size of Annexation Area The Annexation Area is 0.2169 acres in area. E. Buildings and Land Use The site currently contains one single - family detached structure. It is proposed to be zoned "SF1" Single Family Residential upon approval of the City Council and incorporation into the City of South Bend. No rezoning is being sought with this annexation. G. Population One (1) person currently resides in the Annexation Area. H. Tax Rate Per HFA 1001 the tax rates caps for different classifications of property are as follows irregardless of being within South Bend or unincorporated St. Joseph County: Property ELoperty Type 2009 After 2009 Homestead 1.5% 1.0% Non - Homestead Residential 2.5% 2.0% Agricultural 2.5% 2.0% Other commercial 3.5% 3.0% I. Assessments 2007 payable 2008, St. Joseph County Auditor property tax records: Land and Improvements Net: $48,900 3. Municipal Legislative District The Annexation Area will be in the 5th District. K. Hiring Plan It is anticipated that this annexation will not result in the elimination of jobs for employees of any other governmental entities. The Centre Township Trustee has been notified of this Annexation. Berkheiser (60601 South Main) Annexation Area S SECTION III. MUNICIPAL SERVICES A. Public Works Sewer - A thirty inch (30 ") diameter public sanitary sewer is available on Main Street to serve this one lot annexation area. Revenue from customers on this sewer will be sufficient to operate and maintain the facility without burden to other ratepayers. The costs for extending the sewer on Main Street are recoverable from new customers. The development fee for connection of Lot 33 to sanitary sewer service will be $3,000 payable at the time of permit application. Water - The South Bend Water Works currently has a 12" water main on the west side of Main Street. This is a looped water main that will provide more than adequate capacity for 60601 South Main Street. Extensions of, or taps into sanitary sewer and water lines shall be governed by I.C. 36 -9 -22- 2, I.C. 8 -1.5 -3 and 4, and the rules and regulations of the South Bend Water Works and Sewer Utility. Waivers of Annexation — No waivers of annexation are in effect for the Annexation Area. Streets - The segment of Main Street in front of this property is proposed for reconstruction by the State of Indiana as part of the U.S. 31 Realignment project. The City of South Bend currently lights and maintains Main Street. No additional public works facilities are contemplated for this annexation area. There will be no additional cost to the Department of Public Works if this area is annexed. General Budget Analysis 2008 Actual Budget Report for the Department: Expenditures: $6,303,240 Miles of Roadway in City: @480 Cost per Mile: @$13,131,75 New Mileage within Area: @.00miles (feet) Estimated Maintenance cost for Annexation Area per year: @$0 B. Police Department The Annexation Area would be expected to be added to the already existing BEAT 16. Police patrols, traffic enforcement, and emergency responses will be part of the services the City will offer to this area. This proposed annexation would require officers to cover a relatively small additional area to this beat. At this time it is not expected that this annexation would cause calls for service to increase significantly and it is not anticipated that it will be necessary to increase police patrols beyond the already existing beat patrol at this time. The area under consideration is not expected to cause any unusual problems. Bej kheiser (60601 South Main) Annexation Area 6 At the present time the cost for servicing the proposed area is not expected to impact the existing budget of the Police Department with any significance. However, this area, as well as all other areas of the City, will continually be monitored for level of service demands and other criteria that would necessitate additional resources through budgetary increases or possibly shifting of existing resources, such as a beat restructure. Police services and response time in this area can be expected to be comparable and consistent with that as in all other areas of the City. Police coverage to this area could begin immediately upon annexation and coordination of the conversion of the 911 emergency phone system for that area. Note: The cost of service for this Annexation Area.is based on the number of parcels. Fire Department Fire Response - The City provides a fully staffed, full time fire department housed in 12 fire stations strategically located throughout the city. The Annexation Area will be serviced primarily by Station #10, located at 5303 York Road, approximately 2.6 miles away. Additional l=ire Department units would respond from Fire Station #1 which is approximately 3.3 miles away and Fire Station #5 which is approximately 3.5 miles away. The South Bend Fire Department does not foresee any unusual fire protection problems related to this annexation. Response times will be comparable to other areas of the City. No additional equipment will need to be purchased or personnel hired to service the Annexation Area. Adequate water supply will be necessary as development takes place. Emergency Medical Response - The City, under contract with St. Joseph County, provides emergency medical response to the unincorporated areas of St. Joseph County. Of the seven ambulances currently in service, 3 are dedicated for response to the unincorporated areas. These are Medic Units #10, 11, and 12. Upon incorporation, the Annexation Area will be serviced by Medic #1, located at Fire Station #10. Emergency medical response will continue to be provided by the City of South Bend. Response times will be comparable to other areas of the City. No additional equipment will need to be purchased or personnel hired to service the Annexation Area. Note: The cost of service for this Annexation Area is based on the number of parcels. Household information is provided for comparative purposes. The Department of Code Enforcement will be able to provide services to the Annexation Area with comparable response times. The Department will respond to calls for service upon the effective date of the Annexation. Environmental Services Wastewater Treatment - Wastewater treatment services are supported by user fees, and are paid through the Water Works billing system. Solid Waste - Industrial, commercial and apartment customers are not served by the Bureau of Solid Waste. The annexation will eventually contain multi - family residential units and commercial. These uses will have centralized waste collection locations. A licensed private waste hauler will be required to serve these developments. As single- family, duplex units are constructed, The Division of Environmental Services could service them at the rates noted below. Administrative Services The City of South Bend provides a wide range of services other than those noted above, such as the Mayor =s office, the Legal Department, and the Parks & Recreation. These services are available upon the effective date of the Annexation. Full and dedicated response for non- capital services will be in place within one year of the effective date of the Annexation. Costs for these services have not been calculated. The incorporation of the Annexation Area will not effect the provision of other services currently provided to this property on a county -wide basis. The St. Joseph County Health Department, the St. Joseph County Public Library, the Area Plan Commission and the St. Joseph County /South Bend Building Department are some of the county -wide agencies and their services that will continue to provide the same type and level of services to the Annexation Area. LAND USE ANALYSIS & DEVELOPMENT CRITERIA The proposed annexation will add a pre - existing single- family structure to the City of South Bend in its' current state. Any future changes to the structure will need to meet the City's applicable building and zoning ordinances. Ber heiser (60601 South Main) .Annexation Area 10 SECTION V. FISCAL IMPACT 1) Essential city services can be made available to the residents (and territory) of the Annexation Area in a timely and comparable fashion per the requirements of State law and this fiscal plan. 2) The City is financially able to support city services to the territory sought to be annexed. 3) Required improvements made by the petitioner and /or owner of the parcels must be made in accordance with the standards of the City of South Bend. 4) Required improvements made by the City will be completed within the time frames provide by State law and this fiscal plan. S) All figures are estimates. Final cost of capital expenditures, if any, will not be determined until bids are publicly solicited, contracts are awarded and projects are closed out. 6) Property tax revenue and land assessment estimates are based on a combination of: 2007 payable 2008 tax rates, taxes paid in previous years by a comparable development, estimates of units built, estimates of unit values and land assessments, and tax abatements or adjustments, if any. Property tax revenues based upon full implementation of HEA 1001. 7) Department expenditures and revenues are derived from the City of South Bend Budget. 8) The estimated costs to provide services, noted in Section III, Municipal Services, is a City- wide average based on a particular budget year. In the case of the proposed development in the Annexation Area, some of these services will not be required or possibly requested for many years. Hence, the cost of providing services over the first five should be evaluated with this in mind. We have had work sessions on the past 4 years of Progress on the CSO Long Term Control Plan and what comes next in the next 4 years. We are now prepared to discuss the rates necessary to continue to move forward with environmental health stewardship and meet the federal mandate. We once again need to address rates to keep moving forward environmentally on controlling overflows from our combined sewer system, including basement backups, It is never popular to increase rates, but that is the necessary task before us, It is over 4 years since the Common Council voted on sewer rates, It is time to review our progress, current status and make decisions on the next stage of implementing the plan we worked collectively as a community to create a 20 year roadmap for this major environmental infrastructure aspect of City Plan. We are facing a big $ 450 million CSO LTCP implementation ahead for the next 20 years. We will operate under Environmental Protection Agency, Indiana Department of Environmental Management and Federal Department of Justice Consent Decree for a long time (same as Mishawaka, Elkhart and many other communities in Indiana). Rates need to increase in 2010 and for the next 3 years (each year) to produce capital for sewer infrastructure investment of $70 million of dollars for the next priority group of projects, We continue to focus on public health as our priority most supported by the public - -- continuing to address chronic basement backup areas. There will be some more significant work to maximize our wastewater treatment plant wet weather capacity, both for higher flows and in terms of organic, nitrogen, solids and disinfection processes. This treatment plant aspect is the most cost - effective environmentally acceptable project to help everyone in the community. As local leaders, we want to avoid sewage backups into basements; we want to keep raw sewage out of the river after most rain storms. We also want to buffer rates. However, it should be communicated clearly that the EPA is mandating that we act and pushing us eventually beyond engineering break -even point - -- where each increment of cost produces an equal or greater increment of environmental benefit (called knee of the curve economic project scope). The EPA is eventually under the pending consent decree pushing us and other CSO communities under the 20 year plan to sewer rates that are above the guidance in the Clean Water Act of 2 % of median household income allocated to sewer bill (in the guidance in the Clean Water Act this is accepted as the level of "widespread economic hardship" due to high sewer rates). Reducing engineers and operations requests (Scenario 1) to a level that is progress from first 4 years, but not as high requested --- $ 70 million is that buffered need level to show progress to EPA and restraint to ratepayers in scenario 2 of the rate study —of which $60 million raised through sewer rates and $ 10 million from other existing sources of capital. 3.) We reduced taxes paid as PILOT to current rate plus 5 % per year. 4.) We propose meeting the $ 70 million capital investment level by use of $ 10 million of EDIT in a companion ordinance to follow to keep sewer rates increases to single digit and annual increases under a dime a day for typical residential customer using 5,000 gallons per month. AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA AMENDING VARIOUS SECTIONS OF CHAPTER 17, ARTICLE 2, OF THE SOUTH BEND MUNICIPAL CODE TO ADJUST SEWER RATES AND CHARGES INCREMENTALLY THROUGH 2013 STATEMENT OF PURPOSE AND INTENT On November 28, 2005 South Bend enacted a sewer rate adjustment through Ordinance #9639 -05 which set rates for the years 2006 through 2009. At this time the 2009 rates in Ordinance #9639 -05 apply to South Bend's sewer utility customers. South Bend is under a mandate from the federal Environmental Protection Agency (EPA) to greatly reduce combined sewage overflow (CSO) events in the St. Joseph River in compliance with the CIean Water Act. The cost of meeting this mandate and protecting the St. Joseph River is substantial, and South Bend has prudently planned for this remediation through a 20 year environmental infrastructure improvement and replacement process. The cost of river protection through improvements to the sewage utility's infrastructure is financed through sewer rates, and South Bend's current rates are inadequate to cover EPA mandated changes to the City's sewage treatment system. Additionally, South Bend's basic costs of operation and maintenance of its sewer utility have increased despite innovative cost savings programs initiated by the City's Environmental Services Department. It, therefore, becomes necessary to increase sewage utility rates across the board for all users and it is prudent to do so on an incremental basis to correspond with expected increased costs of Clean Water Act remediation, and the expected increased costs of general operation and maintenance. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND as follows: Section I. Chapter 17, Article 2, Division 4, Section 17 -20 of the South Bend Municipal Code be and hereby is amended to read as follows: Section 17 -20. Rates established. Every person whose premises are served by said sewage works shall be charged for the service provided. These charges are established in order that the sewage works shall recover revenue which is proportional to its use of the treatment works in terms of volume and load. User charges are levied to defray the cost of operation and maintenance (including replacement) of the treatment works. User charges are subject to the rules and regulations adopted by the U.S. Environmental Protection Agency published in the Federal Register February 17, 19$4 (40 C.F.R. 35.2140). Replacement costs, which are recovered through the system of user charges, shall be based upon the expected useful life of the sewage works equipment. Section I1. The Water Utility released a Statement of Qualifications (SOQ) document to six engineering firms with water treatment experience. After an extensive evaluation process, we selected a firm with previous experience with an identical project. The amendment to the Salary Ordinance reflected in the revised Attachment consists in the addition of a new position: Director — Energy Conservation. The 2010 salary for this position is $68,016.00. This new position does not affect in any way the 2010 General Fund budget because the position wiII be funded entirely from an Energy Efficiency & Conservation Block Grant for calendar years 2010 and 2011. Thereafter, from 2012 forward, the position will be funded by the energy consumption savings achieved from the work and programs of the Director of Energy Conservation. The addition to the detail sheet appears at page 2, and the position has been highlighted for your ease of review. Dear President Dieter: The attached ordinance is offered for Council consideration. It deals with a new appropriation from Sewage Works Capital Fund ( #642) under the category of "Treatment and Disposal of Equipment" in the 2010 Sewage Works Capital budget for wastewater. Sufficient monies are in Fund #642 to cover this requested appropriation. The total dollar amount to be appropriated is $ 300,000. These funds will be primarily used to cover rehabilitation and upgrade of the old Raw Sewage Pump # I which was recently replaced. A second of the three raw sewage pumps at the wastewater plant required to meet "firm capacity" requirements in the NPDES permit issued by IDEM to the City has failed and needs replacing. Zoning and land use history & trends: According to our agencies historical zoning maps, the property was zoned D Light Industrial prior to the 2004 update of the City Zoning Ordinance. The 1966 aerial shows this site and the property to the west as being industrial or vacant while the properties to the north and east were largely residential. However, between 1971 and 1986, all the adjacent properties were converted to industrial uses as a part of the Monroe Park Industrial Park development. The existing structures have been located upon this site since approximately 1945. Traffic and transportation considerations: Both Fellows Street and Rush Street are two Ianes. Pursuant to Chapter 2, Article 6, Section 2 -82 of the Municipal Code of the City of South Bend, this petition was referred to the Department of Community and Economic Development for purposes of investigation and preparation of a report determining whether the area qualifies as an Economic Revitalization Area pursuant to I. C.6 -1.1 -12.1 and whether all zoning requirements have been met. The Department of Community and Economic Development has reviewed the petition, investigated the area, and makes the following report. PROJECT SUMMARY Olive Cleveland Partners are in the process of purchasing vacant Lots No. 14 & 15 from the BW Business Park, LLC, Olive Cleveland intends to construct a warehouse /distribution facility to accommodate the relocation and expansion of an existing tenant, Invacare Corporation. The new building will have a total of approximately 80,000 square feet, and will feature 32 feet clear height, 15 docks, grade level access and approximately 5,000 square feet of office space. The building will incorporate energy efficient design elements including heating and lighting. The estimated cost of the building is $2,400,000. Invacare Corporation is a leading manufacture and designer in the worldwide home medical equipment market. The company designs, manufactures and distributes an extensive line of health care products for the non -acute care environment, including the home health care, retail and extended care markets. February 19, 2010 Page 2 The Petitioner has just begun collecting information on potential suppliers and contractors for the project. For this reason they were unable to answer the questions related to suppliers of construction materials and construction contractors. They intend to submit this information prior to the Common Council meeting to consider their confirming resolution. At that time Final points will be awarded and the length of the abatement term set. Based on current information, the Petitioner will score sufficient points for a three -year term. The Petitioner has supplied information from a previous project to be used for estimation purposes. If they score all of the points for construction they would have enough for five years. For purposes of consideration of the Declaratory Resolution we are estimating the term at six years to allow for any extra adjustment. Anything less will result in a reduction in the amount of tax revenue abated. Assuming a six -year abatement term is approved at the Confirming Resolution, the total taxes to be abated during that term are estimated at $210,386. Total taxes to be paid during the six -year term are estimated at $218,637. If the term remained at three years, total taxes to be abated are estimated at $123,376. Total taxes to be paid over the three -year term are estimated at $91,136. EMPLOYMENT IMPACT Per the petition, it is estimated that the project will not create any new, permanent full -time positions. However, it will retain 23 existing permanent full -time positions, including 7 existing permanent full -time minority employees, with a total annual payroll of $668,820. ABATEMENT QUALIFICATION 1.
