REGULAR MEETING MAY 24 2010 147 <br />ONE {I) 2009 BRUSH BANDIT CHIPPER <br />ONE (1) 2010 FORD TANDEM DUMP TRUCK <br />ONE (1) 2010 FORD TANDEM DUMP TRUCK <br />WHEREAS, I.C. 36-1-11-9 authorizes the Board of Public Wnrks to trade in or exchange <br />City-owned property far partial or full reduction in the purchase price of property of similar nature. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE <br />CITY OF SOUTH BEND, AS FOLLOWS: <br />1. The following described property shall be traded-in for property of a similar nature and <br />shall be removed from the inventory of the City of South Bend: <br />ONE {1) 2009 BRUSH BANDIT CHIPPER <br />ONE (1) 2010 FORD TANDEM DUMP TRUCK <br />ONE {1) 2010 FORD TANDEM DUMF TRUCK <br />ADOPTED this 24th day of May 2010. <br />BOARD OP PUBLIC WORKS <br />slGary A. Martin, Clerk <br />ADOPT RESOLUTION NO. 32-1010 _ A RESOLUTION OF THE BOARD OF PUBLIC <br />WORKS Op' THE CITY OF SOUTH BEND INDIANA ACCEPTING THE TRANSFER OF <br />REAL PROPERTY FROM ST. JOSEPH COUNTY INDIANA <br />Upon a motion made by Mr. Inks, seconded by Mr. Litirell and carried, the following Resolution <br />was adopted by the Board of Public Works: <br />RESOLUTION N0.32-2010 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, INDIANA <br />ACCEPTING THE TRANSFER OF REAL PROPERTY <br />FROM ST. JOSEPH COUNTY, INDIANA <br />WHEREAS, St. Joseph County, Indiana (the "County") is the owner of certain real <br />property situated in St. Joseph County, Indiana and being more particularly described in Exhibit <br />"A" (the "Real Property"}; and <br />WHEREAS, the City of South Bend, Indiana, acting by and through its Board of Public <br />Works (the "City"}, desires to acquire the Real Property from the County for the purpose of <br />rehabilitating the Real Property and returning the Real Property ko the tax rolls; and <br />WHEREAS, the County desires to transfer the Real Property to the City for the purpose <br />stated herein; and <br />WHEREAS, pursuant to I.C. 36-2-2-20, the Board of Commissioners of St. Joseph <br />County, Indiana (the "Board") has custody of and may maintain all real property of St. Joseph <br />County; and <br />WHEREAS, pursuant to I.C. 36-9-b-3, the South Bend Board of Public Works (the <br />"BPW") has custody of and may maintain all zeal property of the City of South Bend; and <br />WHEREAS, pursuant to I.C. 36-1-11-8, the County, acting by and through the Board, <br />may exchange or transfer property with another governmental entity upon terms and conditions <br />agreed upon by the two (2) entities as evidenced by the adoption of substantially identical <br />resolutions of each entity; and <br />
