ORDINANCE NO. ~ Obt Z t ~ <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND TO <br />TRANSFER ALONZO WATSON PARK FROM THE BOARD OF PARK <br />COMMISSIONERS TO THE CIVIL CITY OF SOUTH BEND <br />STATEMENT OF PURPOSE AND INTENT <br />The City of South Bend desires to facilitate the development of a comprehensive community <br />center supported in part by the Iocal community, and where children and families would be exposed <br />to different people, activities and arts that would otherwise be unavailable, and provide certain non- <br />secularprograms and activities which the City believes will be of benefit to the City and its citizens <br />("Ray and Joan Kroc Corps Community Center"). <br />In order to accomplish this, the property known as Alonzo Watson Park is needed for this <br />project. Upon a motion at its meeting of April 19, 2010, the South Bend Board of Park <br />Commissioners, recommended that Alonzo Watson Park, as described in Exhibit "A" attached <br />hereto and incorporated herein, be transferred to the Civil City of South Bend. The Common <br />Council, under Ind. Code § 36-10-4-18 has the authority to transfer park land. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY <br />OF SOUTH BEND as follows: <br />Section 1. Alonzo Watson Park as described in Exhibit "A" attached hereto and <br />incorporated herein, be transferred to the Civil City of South Bend. for its own use including <br />potential conveyance to third parties in accordance with Indiana statutes. <br />Section 2. Pursuant to Ind. Code § 36-10-4-18, the proceeds from the sale of the land <br />described in Exhibit "A", if any, shall be credited pro rata to the Park Department, and the <br />proceeds shall be expended for the improvement of the remaining park land or for purchase <br />of other land for park purposes. <br />Section 3. This Ordinance shall be in full force and effect from and after its passage by the <br />Common Council and approval by the Mayor. <br />~~ - <br />1 ~~~ <br />Member, South Bend Common Council <br />
