ORDINANCE NO. AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROPRIATING THE SUM OF $71,000.00 FROM COLLEGE FOOTBALL ' HALL OF FAME CAPITAL FUND (#677) FOR THE HALL OF FAME BUILDING'S REPAIRS, MAINTENANCE, OR CAPITAL REPLACEMENT STATEMENT OF PURPOSE AND INTENT In September 2009, this Council approved and adopted the 2010 budget for City operations which did not include funding for repairs, maintenance or capital replacement for the Hall of Fame building owned by the City of South Bend. This was due to the fact that the National Football Foundation had recently announced its termination of the agreement between South Bend and the Hall of Fame expiring on December 31, 2010. The City Engineering Department has recently determined that certain expenditures and repairs of a capital nature are necessary to maintain the facility's mechanical parts in good working order, which costs are the responsibility of South Bend as set forth in the Second Interim Agreement between the City of South Bend and the National Football Foundation dated July 21, 2076. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA as follows: SECTION I. The sum of $71,000.00 is hereby appropriated from and set aside within College Football Hall of Fame Capital Fund (#677) for purposes of repairs and other expenditures of a capital nature necessary to maintain the Hall of Fame Building and its mechanical components in good working order. SECTION II.
