~~, <br />~~ <br />`7 - <br />~~~'~~/ <br />~~' ~~ <br />~C~ ~ PUBLIC WORKS AND PROPERTY VACATION COMMITTEE March 22, 2010 <br />David Varner, Chairperson, Public Works and Property Vacation Committee called the meeting to <br />order at 3:05 p.m. <br />Committee Members Present: Timothy Rouse, Tom LaFountain <br />Other Councilmember's Present: Derek Dieter, Oliver Davis, Ann Puzzello, Karen White, AI <br />"Buddy" Kirsits <br />Other's Present: Liz Maradik, Lisa Bognar, Gladys Muhammad, Hardie Blake, Kyle Chamberlin, <br />Gregg Zientara, Don Inks, Dennis Andres, Carl Litrell, <br />Agenda: Bill No. 07-10 -Vacation -Allen's Alley <br />Bill No. 12-10 -Vacation -Alley 900 W. Colfax <br />BILL NO. 07-10 <br />Chairperson Varner notified the committee that the petitioner to vacate the alley had formally <br />requested Bill No. 07-10 be continued until the meeting of April 12~''. Councilmember LaFountain <br />so moved. Councilmember Rouse seconded. All affirmed. <br />BILL NO. 12-10 <br />This bill requests the vacation of an eight foot wide alley at 902 W. Colfax. This property is part of <br />the historic Dunbar Corner currently undergoing extensive restoration by South Bend Heritage. <br />Liz Maradik from South Bend Heritage was recognized by Chairperson Varner to make a <br />presentation. The owner of an adjacent parcel, Lisa Bognar, was then recognized to present her <br />concerns. In addition to feeling she had not been given proper notice Mrs. Bognar listed several <br />concerns. Namely, concerns regarding potential runoff, liability, clean-up and restoration of the <br />affected strip. Council Attorney Kathy Cekanski-Farrand interjected that Phil Byrd the Executive <br />Director of South Bend Heritage (SBH) had agreed to written commitments to address Mrs. <br />Bognar's concerns expressed at an earlier hearing. These commitments, she noted, had not <br />been forthcoming, Mr. Byrd, in attendance, apologized and requested a continuance until the <br />meeting of April 12, 2010. Chairperson Varner accepted the request. Councilmember <br />LaFountain so motioned. Councilmember Rouse seconded. All affirmed to continue <br />consideration until April 12, 2010. Chairperson Varner suggested South Bend Heritage work with <br />Mrs. Bognar to allay her concerns in writing for the next meeting. <br />There being no further business to come before the committee at this time, Chairperson Varner <br />adjourned the meeting at 3:18 p.m. <br />Respectfully Submitted, <br />~/ <br />David Varner, Chairperson <br />Public Works and Property Vacation Committee <br />
