4 <br />BE IT RESOLVED, by the Board of Public Works of said City that in <br />pursuance to Section 2 of an Act of the General A iembly of the State of Indiana, <br />approved March lst. 1923, being Chapter 36 of the lots of 1923, the New York Central <br />Railroad Company be and they�are hereby ordered to prepare or caused to be prepared <br />and filed within Sixty (60) days after notice as provided by said act, complete plans <br />and specifications, the same to be in particular coveri.ng all work required by sadd <br />Resolution to be dnae except pavement, -sidewalks, drainage and approaches. <br />All other steam railroad companies, having tracks connecting with <br />or intersecting the tracks of the New York Central Railroad company and which said <br />tracks will have to be changed on, over or under certain streets if such companies shall <br />desire to maintain such connection or intersecting tracks shall likewise file plans <br />and specifications in the office of such Board of any changes necessary in thier <br />tracks resulting from said improvement, <br />Be it Further Resolved:, that`the Board of Public Works dues hereby <br />order plans and specifications to be prepared by the City Engineer for the Board of <br />Public Works and filed in the office of said Board for any and all work required to be <br />done in connection with such improvement for pavement, sidewalk, drainage and <br />approaches and such work as shall be required on that .part of the streets the grade of <br />which is changed by �suc improvement. In all eases where the street or highway is to <br />be:`carried over,the::railroad track or tracks, the plans amd spEficiation for approaches <br />shall include the work required to be done.up to the abutments supporting the super- <br />structure, but shall .not include the abutments, and in all eases where the street or <br />highway is to be carried under the railroad track or tracks, the plans and specificatl o <br />for approaches shall only include the work required to be done outside of the right <br />of way of the railroads affected. <br />At the same time that such Plans and specifications are filed by any <br />of,such railroad companies or by the Board of Public Works, such companies and'such <br />board shall also file with the said board, an itemized estimate of the complete cost <br />of the work specified in the pans and specifications so filed by it 033 them. <br />Be it further resolved, that the Chicago, South Bend & Northern <br />Indiana Railway Cmpany be and the same is hereby notified. to file such plans and <br />specifications in particular a`s are necessary to comply with the requirements of the <br />abovementioned act. <br />All of said plans and specifications and all estimates shall be <br />placed on file in the office of the Board of PUblic Works within Sixty (60) days after <br />notice of the adoption of this resolution. <br />Notice of the adoption of this resolution is hereby ordered to be <br />served personally on all Railroad Companies and all interurban and Street Railway <br />Companies affected by said proposed improvement under Modified Track Separation <br />Resolution No. 4. <br />Adopted this 28th. day of January ,1925. <br />L. HONER <br />Board of Public Works <br />(SEAL) <br />Notice is further g1ven 'that in the event that any of `the Railroad <br />Companies or� Sheet Railway Companies affected shall fail, ne'aieet or refuse to file <br />such plans, -specifications and itemized estimates as required in 'said resolution , the <br />said City will cause the same to be prepared and filed as provided by Section 2 of <br />Chapter 36 of the Acts of the General Assembly of the State of Indiana, approved <br />March 1,1923. <br />L.
