ed.- <br />specifically set forth in said list, and that the respective amounts of damages <br />contained in the said list be and are hereby awarded to the several tracts of lend as <br />specifically sat forth in said list, and that net benefits or net damages, as the <br />case may be as to, -the respective tracts of land, contained in said list are hereby <br />awarded or assessed, as the case may be as to the said several tracts of land. <br />T The Board hereby further sets off the benefits and damages each against <br />the other where both benefits and damages are assessedm against the same piece <br />property, tract of land or interests, and hereby fixes the said respective net bene- <br />fits as the amount that shall be paid by the respective owners as benefits, and further <br />hereby fixes the respective net damages as to the several tracts as the amount that <br />shall be paid to the owners of the respective tracts as damages. <br />Thereupon, upon motiondm4eand seconded and unanimously adopted the <br />11th. day of February 1925 at 7:15 P.M. was fixed as the day on which this Board will <br />receive or hear remonstrances from persons with regard to the amount of their re- <br />spective awards of a,ssessmentav, and the Clerk of this Board Was instructed to prepare <br />and cause to be duly and legally given, notices to the owners of each parcel of property, <br />showing the amount of the assessments or awards, with a description of the property <br />affected, and the date of said hearing. <br />Resolution adopted as follows with. form of notice. <br />RESOLUTION REQUIRING THE FILING OF PLANS, SPECIFICATIONS AND <br />:ESTIMATES UNDER MODIFIED GRADE SEPARATION RESOLUTION <br />No. 4. <br />WHEREAS on the 9th. day of January 1925 modified Resolution No. 4 <br />providing for the separation of grades of the New York Central Rai3Road Company by <br />the elevation of the same over.certain streets in said resolution named, was duly and <br />legally adopted and confirmed by the Board of Public Works of the City of South Bend, <br />Indiana, and <br />WHEREAS, said resolution as so adopted and confirmed was submitted <br />to the Common Council.of the City of South Bend, Indiana for its action thereon and was <br />by Ordinance No. 2452 duly confirmed and approved by said Common Council of the <br />26th. day of January 1925, THEREFORE, <br />BE IT RESOLVED, by the Board of Public Works of said City that In <br />pursuance to Section 2 of an Act of the General Assembly of the State of Indiana, <br />approved March ist., 1923, being Chapter 36 of the Aols of 1923, the New York Central <br />Railroad Company be and they are hereby ordered to prepare or caused to be prepared <br />and filed within sixty (60) days after notice as provided by`saud act, complete plans <br />and specifications, the same to be in particular covering all work required by scud <br />resolution to be done except pavement,, sidewalks, drainage and approaches. <br />All other Steam Railroad Companies having tracks connecting with or <br />intersecting the tracks of the New York Central Railroad Company and which said <br />tracks will have to.be changed on, ever or under certain streets if such companies <br />shall desire to maintain such onnection or intersecting tracks shall likewise file plans <br />and specifications in the office of such Board of any changes necessary in. their <br />tracks resulting dfrom said improvement.; <br />Be it further resolved, that the Board of Public Works does hereby <br />order plans and specifications to be prepared by the City Engineer for the Board of <br />Public Works and filed in the office of said' Board for any and all work required to be <br />done in connection with such improvement for pavement, sidewalk, drainage and approaches <br />and such work as shall be required on that part of the streets the grade of which is <br />changed by such improvement. In all -cases where the street or highway is to be <br />carried over the railroad track or tracks, the plans and speeific6tion for approaches <br />shall inloude the work required to be done up to the abutments supporting the super- <br />structure, but shall not include the abutments, and in ail.cases where the street or <br />highway is to be carried under the railroad track or tracks, the plans and specification <br />for approaches. shall only inleude the work required to be done outside of the right of <br />way of the railroads affected. <br />
