~~1 <br />~` __. <br />~~ ~~ <br />~~',,~ <br />~C<~ ~ PUBLIC WORKS AND PROPERTY VACATION COMMITTEE February 22, 2010 <br />David Varner, Chairperson, Public Works and Property Vacation Committee called the meeting to <br />order at 3:20 p.m. <br />Committee Members Present: Timothy Rouse, Tom LaFountain (3:30) <br />Other Councilmember's Present: Derek Dieter, Oliver Davis, Ann Puzzello, Karen White, AI <br />"Buddy" Kirsits <br />Other's Present: Jeff Parrot, Rita Kopala, Kathleen Cekanski-Farrand, Rich Deahl, Brad <br />Toothaker, Ann-Carol Nash, Gregg Zientara, Chief Boykins, Don Inks, Gay Gilot, Ken Fedder, <br />Mayor Steve, Jitin Kain, Matt Chelbowski <br />Agenda: Bill No. 07-10 -Alley Vacation -Allen's Alley <br />Bill No. 09-10 -Appropriation -Install Emission control devices on City Trucks . <br />BILL NO. 07-10 <br />Chairperson David Varner elected to conduct the hearing even though there was not a quorum. <br />A quorum was achieved with the arrival of Tom LaFountain at 3:30. Chairperson Varner <br />recognized Rich Deahl, an attorney with Barnes & Thornburg, who represented the petitioner <br />Brad Toothaker. Deahl gave a brief description of the proposed vacation before introducing the <br />developer Brad Toothaker who described the overall $5.5 million project. He said the vacation <br />was needed to provide an additional row of parking planned for the project. Varner indicated the <br />Council had received a letter requesting the bill be continued due to the fact that he was an <br />adjacent property owner with questions who was unable to attend the hearing. Attorney Ken <br />Fedder representing the adjacent owner corroborated the request. Toothaker was willing to <br />accept a delay until March 8. In the interim Director of Public Works Gary Gilot said he would <br />work with the parties to find a solution. Councilmember Rouse moved and Councilmember <br />LaFountain seconded all supporting a continuance until March 8cn <br />BILL NO. 09-10 <br />Matt Chlebowski, Director of Central Services explained the city had received a $40,000 grant <br />from the EPA to install particulate catalysts on 30 of the city's diesel trucks. The bill would <br />appropriate this money from fund 222. Councilmember Rouse motioned and Tom LaFountain <br />seconded the motion to send the bill to the full Council favorably. All supported. <br />Under miscellaneous Chairperson Varner suggested the Council review and recommend a <br />prioritization of Redevelopment Department proposed projects. He offered to find an acceptable <br />date. Chairperson Varner also suggested the Council's Economic Development Committee <br />jointly conduct the review with Public Works and Property Vacation.
