<br />Company respectfully petitions your Honorable Board for the"right and authority to
<br />change, alter and construct its tracks where the same across Indiana Avenue in South
<br />Bend, Indiana, and for a distance of -one-half ( 1 ) block north of and one half ( )
<br />block .s-u_th_of_ said Indiana Avenue by changing Yts switch tracks, -switches, swiToh
<br />stands, watchman's Shan:Ly and connections and constructing new tracks in accordance with
<br />the blue print ps hereto attached, worked exhibit "A" and made a part of this
<br />_petition; and, since the proposed changes and alterations desired require the 1txx t**Aftns
<br />construction of a short pierce of new tra ok, this petitioner submits herewith, as a
<br />part of this petition as exhibit "B", a proposed contract with the City of South Bend,
<br />to cover said changes and new construction.

<br />the Board' -of Public Works of the .City of South Bend, Indiana, and the Pittsburgh,
<br />Cincinnati., Chicago & St. Louis, Railroad Company WITNESSETH:
<br />That the Pittsburgh, Cincinnati, Chicago & St. Louis Railroad
<br />Company ( suebossor to the Vandalia Railroad Company) is given the right, provilege and
<br />authority to change the location of.its existing railroad tracks, switches, wathman
<br />shanty and eonneetiond at and across Indiana Avenue and for one-half block north of
<br />Indiana -Avenue and one-half block south of Indiana Avenue in South Bend, by constructing
<br />a new track across Indiana Avenue on its right of -nay west of its present existing main
<br />track and tomove the watchman's shanty east of the present existing main track and to
<br />change the conntion of the present existing tracks south of Indiana Avenue and north of
<br />Indiana Avenue in eonfwmity to, and as specified in the blur p:bint map hereto
<br />attached, marked exhibit "A and made a part hereof.
<br />• The right and authority to lay said additional new track and to
<br />make said changes and relooatioA of said existing main.tracks is -given and granted
<br />subject to all the terms and conditions of the original ordinances under which said
<br />railroad company,-ir its predecessors, is given or granted the right to construct,
<br />maintain and operate its railroad tracks into said City and across the streets thereof
<br />and say additionais or supplements thereto.

<br />Cincinnati , Chicago & St. Louis Railroad Company by their authorized reprasentatives.
