354 <br />Wednesday May 7Lh, 1924. <br />Continued. <br />WHEREAS, the Board of Public Works of the City of. South Bend, Indiana. did, <br />on the 7th. d'ay .of Mai 1924 adopt a preliminary resolution for the improvment <br />of Bonds Avenue from,Olive St'reef to: Meade. <br />under Improvement Resolution No. in the City of South Bend, Indiana, by construction. on <br />pavement as shown on the plans, and in accordance with the profiles, detail drawings and specificatior•s <br />on file* in the office of the Department of Public Works. <br />AND WHEREAS, we the undersigned, are the only persons owning pro_ - <br />perty on- said street to be improved, and that v+e alone are affected in arty. Hay by said proposed <br />improvement. That we are the sole owners of the separate parcels of land bordering upon said street <br />roposed to be improved. <br />THEREFORE, in consideration that said Board of Publle Works proceed <br />to; improve said Bonds Ave. from Olive Street to Meade Street. Hartzer St. from -Meade St. <br />,to Antho_ ;street Prast Blvd. from Olive St. to Anthony St. ��rederickson St. from Olive Sty <br />-to Metade treet, keede Street from Lincoln Highwat to Frederickson St. <br />As <br />p--posed in said resolution, and for the further purpose of saving time and expense,- we the un_�� <br />} <br />derstgttecf, .hereby waive all objections on and to defense to any defect in said . proceed' ,` - and <br />i <br />to:,,any vication in procedure for the construction of pavements as fixed by Section 8710 of Burn's <br />Re�i' tatutes of 1914. We further waive any right to object to the form of said resolution. We <br />further ':.waive any and all objections to the fact that no advertisement for hearing has been .published <br />as required by law, and that no notices were mailed to the owners of property and that no hearing was <br />held by said Board. . <br />We also consent that said Board shall proceed to let the contract for do- <br />i-n said work in following manner; <br />That they shall notify by mail responsible contractors in the City of South <br />d• f d k b d d + <br />Bend, la Tana, o sat wor to a one un er said resolution, and that they shall receive bids from <br />said contractors for doing of said work, and they shall let the contract for the doing of s4id work to the. <br />lowest responsible bidder, and we waive any objection to the action of said Board in letting said con- j <br />tract in a form and manner other than provided by law, <br />We further consent that the cost of doing grid work shall be assessed: a <br />gainst the different -parcels of real estate owend by us as provided by sections 8710, 871 Ca f 711-b i i 2- <br />8713-8714-8715-8716-8717-8718-8719-8720-8721;. and all acts and laws amendatory- thereof or. <br />supplemental thereto. <br />We further agree that notice given by mail shall be sufficient notice cf tl:e <br />hearing upon the assessments wade for said improvement. <br />Given under our hands on the day and year first above mentioned. <br />Union Trust Company Trustee By.
