REGULAR MEETING MARCH 8 2010 52 <br />APPROVE CHANGE ORDER 7 (FINAL) -EDDY STREET COMMONS SITE UTILITIES <br />PROJECT NO. 108-OOSR TIF <br />Mr. Gilot advised that Mr. Toy Villa, Engineering, has submitted Change Order No. 7 (Final) on <br />behalf of HRP Construction, Inc., 5777 Cleveland Road, South Bend, Indiana, 46628, indicating <br />the Contract amount be increased by $143,406.48 for a new Contract sum, including this Change <br />Order, in the amount. of $3,1©0,349.41.. Upon a motion made by Mr. Littrell, seconded by Mr. <br />Inks and carried, the Change Order was approved. <br />APPROVE FROJECT COMPLETION AFFIDAVIT -IRELAND ROAD STREETSCAPE <br />IMPROVEMENTS - PROJECT N0.109-043 (SSDA TIF <br />Mr. Gilot advised that Mr. Toy Villa, Engineering, has submitted the Project Completion <br />Affidavit on behalf of TGB Unlimited, Inc. dba SIT Bancroft Electric, 25020 State Road 2, <br />South Bend, Indiana 46619, for the above referenced project, indicating a final cost of <br />$74,962.90. Upon a motion made by Mr. Inks, seconded by Mr. Littrell and carried, the Project <br />Completion Affidavit was approved. <br />APPROVAL OF REQUEST TO .ADVERTISE FOR THE RECEIPT OF BIDS -ONE 1 OR <br />MORE, 2009 OR NEWER DISC TYPE CHIPPER (PARKS & RECREATION CAPITAL <br />BUDGET <br />In a memorandum to the Board, Mr. Jeffrey Hudak, Central Services, requested permission to <br />advertise for the receipt of bids for the above referenced equippnent. Therefore, upon a motion <br />made by Mr. Inks, seconded by Mr. Littrell and carried, the above request was approved. <br />ADOPT RESOLUTION NO. 09-2010 - A RESOLUTION OF THE BOARD OF PUBLIC <br />WORKS OF THE CITY OF SOUTH BEND. INDIANA FIXING THE MONTHLY FEE TO BE <br />CHARGED FOR USE OF RESERVED MOBILITY HANDICAPPED PARKING ON CITY <br />STREETS <br />Upon a motion made by Mr. Littrell, seconded by Mr. Inks and carried, the following Resolution <br />was adopted by the Board of Public Works: <br />RESOLUTION NO. 09-2010 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, INDIANA, FLING THE MONTHLY FEE <br />TO BE CHARGED FOR USE OF RESERVED MOBILITY HANDICAPPED PARKING <br />ON CITY STREETS <br />WHEREAS, ind. Code 5-16-9-3 empowers the City of South Bend ("City") to reserve <br />parking spaces on city-streets For the use of persons with physical disabilities; and <br />WHEREAS, Chapter 20, Article 9 of the Municipal Code of the City of South Bend, <br />Indiana authorizes the City's Board of Public Works ("Board") to grant physically disabled <br />persons the exclusive use of a parking space adjacent to or directly across the street from such <br />person's place of employment] and <br />WHEREAS, Section 20.113.3 (b} of the Municipal Code permits the Board to assess a <br />monthly fee for the use of such a reserved space parking permit; and <br />WHEREAS, the Board has heretofore established a monthly fee, and notiv desires to <br />increase the monthly fee for such reserved parking permit. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of <br />South Bend as follows; <br />SECTION I. The fee for the use of a reserved space parking permit shall be as follows: <br />Monthly Fee - <br />Old Rate New Rate <br />$35.00 $45.00 <br />A reserved space permit shall be valid for one (1) year after its issuance and shall be <br />subject to renewal each year. A reserved space permit holder must submit to the Board a <br />renewal form issued by the Board in order to renew the reserved space permit. The Board <br />
