APPENDIX 1 <br /> This investigative report shall include all investigative facts of the case and current case <br /> disposition/closure. Case evidence shall be preserved and stored within the law enforcement <br /> agency's property room where the incident occurred. No evidence will be permanently stored or <br /> housed in the building of the Special Victim's Unit. <br /> Domestic violence criminal offenses handled by the Special Victims Unit should be those <br /> incidents that involve a violent act or behavior, physical assault and/or injury between intimate <br /> relationship partners as defined above, with the primary focus being "violence against women." <br /> 1. FAMILY OR HOUSEHOLD MEMBER DEFINED <br /> For purposes of investigation, the SVU shall investigate certain crimes involving "family or <br /> household member" as defined by IC 31-9-2-44 .5,when the following relationships occur: <br /> a. When the perpetrator is a current or former spouse of the other person; <br /> b. When the perpetrator is dating or has dated the other person within the past year; <br /> C. When the perpetrator is engaged or was engaged in a sexual relationship with the other <br /> person within the past year; or <br /> d. When the perpetrator has a child in common with the other person. <br /> 2. CASE RESPONSIBILITIES OF THE ST. JOSEPH COUNTY SPECIAL VICTIMS UNIT: <br /> a. The St. Joseph County Special Victim Unit shall accept and investigate all incidents involving: <br /> 1) Domestic Violence under IC 35-42-2-1.3, <br /> 2) Rape under IC 35-42-4-1, <br /> 3) Child Molesting under IC 35-42-4-3, <br /> 4) Vicarious Sexual Gratification under IC 35-42-4-5, <br /> 5) Child Seduction under IC 35-42-4-7, <br /> 6) Sexual Battery under IC 35-42-4-8, <br /> 7) Sexual Misconduct with a Minor under IC 35-42-4-13, <br /> 8) Inappropriate Communication with a Child under IC 35-42-4-13, <br /> 9) Incest under IC 35-46-1-3, <br /> 10) Neglect of a Dependent under IC 35-46-1-4, and <br /> 11) Battery to a Child by a Parent, Step-Parent, Guardian, or Caretaker under IC 35-4 <br /> b. The Special Victims Unit will investigate "crime[s] involving domestic or family violence" (as <br /> defined herein)when the incident fits into at least one of the following: <br /> 1) A battery offense under IC 35-42 2, <br /> 2) Kidnapping or confinement under IC 35-42-3, <br /> 3) A sex offense under IC 35-42-4, <br /> 4) Intimidation under IC 35-45-2, <br /> 5) Stalking under IC 35-45-10, and/or <br /> Page A-16 <br />
