Tuesday April 1, 1924. <br />Seventh - If for any reason the Northern Indiana Gas & Electric Company <br />fail to properly mark the location of its service lines or give the wrong location <br />or use new pipe when the trio. pipe could be used, no charges shall be made against <br />the sewer cantraetors and furthermore if for any reason we should lay gas mains or <br />services between the time of the passing of the resolution and the actual con- <br />struction of the sewer all damage of said mains or service shall be taken care of <br />by this company. <br />Gentlemen, this is a rather lengthy proposal and we really feel that if <br />the sewer cantractors and this company closely cooperate along the lines set forth <br />in this letters most of the troubles of lash, season will be eliminated. - <br />Trusting that this proposal will meet with your apprval, we are <br />Yours very truly, <br />"G. Taylor Street from Indiana--4venue to <br />Calvert Street,. <br />The fdllowing contract for Garbage Removal was approved: <br />GARBAGE REMOVAL,CONTRACT <br />This agreement executed this first day of April, 1924, by and between the <br />Xity of South Bend, -Indiana by and through�lts Board of Public Works, hereinafter <br />designated as the City, and Ephriam Lantz, and Alva Lantz, and Christ Schrock, a <br />partnership doing business under the name, style and title of Lantz Brothers and <br />Schrock, hereinafter designated as the contractor, witnesseth that: <br />In easideration of the promises and agreements hereinafter contained, <br />the City promises and agrees as follows, to -wit:- - <br />1. That All of the household garbage collected by the City from and after <br />the First day of May, 1924 to and including the3lst day of December, 1924, shall <br />be delivered to the contractor on the premises now owned or.00ntrolled by said <br />contractors commonly known as the "Old Birdsell Farm" lying north and east of said <br />City. <br />Ali -such garbage shai_l be Collected by said city by trucks equipped with <br />water tight tanks furnished by Said city and the time and manner of such collection <br />and all of the employees engaged in the work of collecting shall be: -under the con- <br />trol and subject to the orders of the Board of Public Works of said city, through <br />its Street Department. <br />3. Household garbage is defined to mean all garbage that may be collected <br />by said city whether from homes, stores,, wholesale houses, restaurants or from any <br />other source, but the city does not undertake to deliver any specified amount of <br />.garbage or guarantee that all of the garbage created or being within. the city from <br />restaurants, hotels and wholesale houses. will be collected. <br />In consideration of the foregoing agreements on the part of the city, the <br />contractor. agrees as fellows, to -wit: <br />1. To furbish at its own expense one-third of all the -trucks necessary <br />to make such collection and delivery.and to furnish competent mento drive the trucks <br />furnished by said contractor. It is,contemplated that such eollectian and delivery <br />can be made by six (6) trucks, and in which event the contractor is to furnish two <br />(2) of said six (6) trucks, but if it becomes necessary to use one or more addition- <br />al trucks, the eontra'at;or agrees to pay one-third of the expense of furnishing, <br />maintaining and the driving of said additional equipment. <br />2. If the contractor shall fail or refuse to furnish said trucks or to <br />pay its share,*f the expense of said additional equipment as above provided, it is <br />agreed that the city may furnish the same and than, the contractor shall be liable <br />far the expense entailed by reason of their said failure or refusal. <br />
