REGULAR MEETING March 12, 2018 <br /> Be it remembered that the Common Council of the City of South Bend reconvened in the Council <br /> Chambers on the fourth floor of the County-City building at 7:53 p.m. Council President Tim Scott <br /> presided with eight(8)members present. <br /> BILLS—THIRD READING <br /> BILL NO. <br /> 13-18 THIRD READING ON AN ALLEY VACATION- <br /> EAST/WEST ALLEY 14' IN WIDTH AND <br /> APPROXIMATELY 120' LONG FROM EAST <br /> RIGHT-OF-WAY OF EMERSON STREET AND <br /> EAST RIGHT-OF-WAY OF NORTH/SOUTH <br /> ALLEY BETWEEN NORTHSIDE BOULEVARD <br /> AND HILDRETH STREET, SOUTH BEND, <br /> INDIANA <br /> Councilmember Karen White made a motion to pass Bill No. 13-18. Councilmember Gavin Ferlic <br /> seconded the motion, which carried by a roll call vote of eight(8) ayes. <br /> RESOLUTIONS <br /> BILL NO. <br /> 18-10 A RESOLUTION OF THE COMMON COUNCIL <br /> OF THE CITY OF SOUTH BEND, INDIANA, <br /> APPROVING THE ISSUANCE OF SCRAP <br /> METAL/JUNK DEALERS/RECYCLING <br /> OPERATION LICENSES FOR CALENDAR <br /> YEAR 2018 PURSUANT TO SECTION 4-51 OF <br /> THE SOUTH BEND MUNICIPAL CODE <br /> Councilmember Jo M. Broden, Chair of the Health and Public Safety Committee, reported that <br /> they met this afternoon and send this bill forward with a favorable recommendation. <br /> Joseph Molnar, Ordinance Violation Bureau Clerk with offices on the 4t'floor of the County-City <br /> Building, South Bend,IN,served as the presenter for this bill.Mr. Molnar stated,This is an annual <br /> process dictated by the South Bend Municipal Code. The Common Council has to approve scrap <br /> metal permits every year. This year there are twelve (12) last year there were eleven (11) so we <br /> are up by one (1). They are primarily located in the City's western and southern corridors. I think <br /> that is mostly due to the zoning classifications in those areas,as they are primarily industrial.There <br /> are certain regulations that have to be met when dealing in scrap metal. For instance, there is a <br /> certain amount of frontage needed away from the road. So, they really have to have a large area <br /> and a lot of those old factory zones are where a lot of the scrap metal dealers are located. I have <br /> also provided a district breakdown. There are six (6) dealers in the 6' Councilmanic District, five <br /> (5) in the 2nd Councilmanic District, and one (1) in the 5th Councilmanic District. All applications <br /> have been reviewed by the Fire Department, the Police Department and the Department of Code <br /> Enforcement. Code Enforcement has issues with only two(2)of the applications.The first one(1), <br /> Steve and Gene's located at 31109 Gertrude,had a number of issues. Code Enforcment is working <br /> with the owner and the owner has been very forward with them. We are issuing a temporary <br /> approval and will be following up every thirty days until everything is complete.The other one(1) <br /> was NORI Metals. They had some litter issues and that has all been cleaned up and Code <br /> Enforcement has approved. I would like to thank Police, Fire, and Code for getting out to the <br /> properties and doing their checks in a timely manner. <br /> Councilmember Jo M. Broden asked, So to the applicant that has a temporary approval, what <br /> happens if they don't comply? <br /> 9 <br />
