A <br />Board met in special hearing at 7:30 Pe M: All members <br />present. City Engineer F. J. Anderson present. <br />This being the date set for the hearing on Condemnation <br />Resolution No. 83 for the opening of a street from Colfax Avenue from Lincoln <br />Way West d►ad from Marion Street to Navarre Street,"in the City of.South Bend,.Indiana. <br />upon said hearing property owners appeared and objected to <br />plan of opening and written remonstrance filed by H. F. Rostiser for Louisa <br />S. Roatiser owners of Lot No. 56 Burrough's Addition, The BoArd therefore after <br />hearing all parties interested present modified said resolution lty including that <br />portion of Lot 6 Burrough's Addition bounded on the north by Navarre Street and on <br />the east by Lot 5 Burrough's Addition, and declare the above described property <br />with modification in all things, condemned and appropriated for public use and this <br />resolution in all things, ratified, confirmed and approved, as modified. <br />The Board further ordered that the City Engineer be-bnstrueted <br />111 ppr area tall of 1 owners o hMr <br />rs of roert nd Qf v 1 ble in rest <br />desct e o e propert ene$ ciaol q a sa dashow � ewhie awards io samaggeess a l <br />assessments of benefits in the above matter. ." <br />The following oRdinance passed by the Common Council of the Citycf South <br />Feb. 25, 1924, was filed: <br />ORDINANCE NO. 2391 <br />An Ordinance authorizing the Board of Public Works of the City of South <br />Bend to condemn centain real estate for the purpose of extending William Street <br />North from Colfax Avenue to Lincoln Way West and for the purpose of openinga new <br />street from Marion Street northwesterly to Navarre Street. <br />Be it ordained by the Common Cuuncil of the Cit7- e-f- Sou- h--Bend-lndisms <br />Sec4.ioa1. That the Board of Public Works of said City be and they are <br />hereby authorized and empowered to condemn a certain tract.of real estate in the <br />City of South Bend, which said tract is shown and indicated by being marked in yel- <br />low upon the attached map and which said tract extends from Marion Street in a <br />northwesterly direction*to the point where Navarre Street intersects Portage Avenue, <br />and be it further ordained that the -said Board of Public Works be and they are <br />hereby authorized and empowered to condemn another tract of'real estate shown and <br />indicated on the attached map by being marked in yellow and extending from LaSalle <br />Avenue on the South to Lincoln Way West on the North and that said Board of Public <br />Works -be further authorized and empowered to condemn a third tracir, of real estate <br />indicated on the attached map by y being marked in yellow and extendinp;from Colfax <br />Avenue on the south to Lasalle Avenue, on the North, except from each of the above <br />described tracts those portions already dedicated to the use of the Public as streets <br />or alleys. <br />Section 2. This ordinance shall be in full force and effect from and <br />after its passage. <br />John J.
