<br />Mr. R. R . Smith MgR. Chicago, South Bend ' Northern Indiana Railway
<br />Company appeared before the Board and presented agreement or contract which was approved
<br />as follows:- '
<br />AGREEMENT.
<br />This agreement, made and entered into this 8th. day of January 1924, by
<br />and between the City of South Bend, Indiana, by and through its Board of Public Works,
<br />hereinafter called the first party, and the Chicago, South Bend & Northhrn Indiana Railway
<br />Company, a corpoation duly created and organized under the laws of the State of Indiana.
<br />hereinafter called the second party,
<br />WITNESSETH:
<br />That CONSENT, PERMISSION AND AUTHORITY Are hereby granted and given
<br />by the first party to and 'vested; in the second party, its successors and assigns, subject,
<br />to and upon the conditions hereinafter specified, to operate vehicles, commonly known as
<br />motor busses, for the purpose of carrying passengers, for a pertDd of ten (10) years from
<br />date of this agreement, over the following route in the City of South Bend.
<br />Starting from the corner of Washington and Main Street, south on Main
<br />Street to Jefferson; west on Jefferson to Lafayette; north on Lafayette to Colfax Avenue;
<br />arrest on Colfax Avenue to La. Porte. Avenue; northwest on La Porte Avenue to Walnut Street;
<br />south. one Walnut Street to Linden Avenue; west on Linden Avenue to Olive Street; north on
<br />Olive Street, to Kaiey School, returning over the same route to Colfax Avenue and Lafayette
<br />Street, thence east on Colfax Avenue to Main Street, and south on Main Street to the
<br />starting point. '
<br />THE SAID SECOND PARTY agrees to operate its said vehicles over said
<br />streets in accordance with the regular time schedule, adequate to the convenience and
<br />necessity of the inhabitants of said city.
<br />THE SAID PAIRST PARTY AGREES NOT TO ENTER INTO A SIMILAR CONTRACT,
<br />granting a similar right to any other applicant, covering the same streets, unless such
<br />applicant first files with the Board of Public Works of said City, a verified statement to
<br />the effect that public voneenience and necessity require the granting of such second right,
<br />and which statement shall be signed by a sufficent number of residents along the streets
<br />over which application is made, to show such public necessity, rpoviding that if such
<br />statement is filed, granting of such contract shall rest in thediscretion of the said
<br />Board of Public Works.
<br />NA D WHEREAS'the public desires the service along the route hereiribefore
<br />specified, and said second party desires to render the service if it is practicable to give
<br />same, bu neither party hereto now knows hhether such service can be practically and profit-
<br />ably rendered, therefrom it is expressly agreed that said second party shall have the
<br />right to cancel this contract at any time within a period of two years fr#pm the effective
<br />date thereof, by giving three months notice in writing to the said first party through its
<br />Board Of Public Works.
<br />IT IS FURTHER AGREED by and between the parries hereto it -ha t irr the
<br />event that the route hereinbefore specified does not serve the bent inter4sts:of the
<br />traveling public, then the City, through its Board of Public Works shall"have the
<br />authority to grant minor changes in the route on petition of the Railway Company, which
<br />shall show the necessity for such change. '
<br />THIS CONTRACT shall be in full force and effect from'and after
<br />its approval and confirmation by Ordinance passed by the Common Council,`and approved by the
<br />Mayor of said City.
<br />In -WITNESS WHEREOF, the first party has hereunto caused its name to be
<br />signed by the mebers of the board of Public Works of the City of South Bend, and the said
<br />second party has caused it name to be signed and its corporate seal to be affixed by Raymond
<br />R. Smith, its Vice President and Oren A. Small, its Secretary, dully authorized thereto
<br />the day and year first above written. No advertising to appear outside of cars, other tha n
<br />the name of the line, after June 1st., 1924,
