<br />That the lepartment of Public `.+orks of the City of South -6-Ad, India,
<br />does by this agreement grant to the Chicago, Sout=l Shore and South Bend Railroad,
<br />authority to construct, maintain and operate an industrial spur railroad track within
<br />THE City of South Bend and over, upon and across "Cal. eT Street as follows:
<br />Beginning at a point on the crest line of la.ley Street, Forty-one (41J feet
<br />south of the southwest corner of Kaley and Lawton Streets in said City; thence across
<br />Ka.ley Street in a eoutheasterly direction, all according to -the Blue print attached:
<br />to the petition for said grant and as indic_Ited thereon.
<br />This grant is made upon the express condition that said track across Xal'ey
<br />Street shall be constructed so gh to conferm with the established grade of said street;!
<br />that said Chicago South Shore and South Bend Railroad shall plank the street between
<br />the rails of said track, and for two (2) feet on the out side of the rails, with planks
<br />not less than two (2) inches in thickness, which shall, at all times, be kept securely
<br />in place and to the grade of Laid street, and shall in the maintenance of said track,
<br />in all things comply with the laz-is of the State of Indiana and the ordinances of the j
<br />City of South Bend.
<br />In :`;fitness whereof, the Department os' Public .`forks, acting for and on behalf;
<br />of the City of South Bend, has caused this agreement to be executed by its duly author-
<br />ized officers on the date first above mentioned, and the said Chicago, South Shore
<br />and South Bend Railroad has hereunto -caused its name to be inscribed.
