Young, Upon the recommendation of M:r, E. accepted. and turned over to the Board of� Yong' Architect, the Board formally new River Park Fire Station No. P4hlie Safety, for occupancy and use, the ` q the building having been completed and is now ready for occupancy. The acceptance of this building is made by the Board with the understanding that the General Contractor will do the following work to complete the contract: Level the perch Pointing the brick on the bottom of porch Clean off the yard of all surplus cement, brick and rubbish Clean mortor off of brick an front of building The Board of Works also agrees to fill in the yard with dirt to establish the proper grade of the lot before the Landscaping is stared by the Board of Safety. Meeting adjourned at II:00 A. M. attested: ]Monday, March 28th. , I927. Board met in special session at 4 P. M. All members present. Board signed a contract with The New Jersey, Indiana & Illinois Rail- way Company and The T. E. Cass Oil Company for the construction and maintainence of a side track acrross the first alley south of the right of way of said Railway Company between Magnolia Street and Kosciuszko Street. Contract as follows: CONTRACT. THIS INDENTURE WITNESSETH and agreement by and between T. E. Cass Oil Company and New Jersey, Indiana & Illinois Railroad Company, part, and the Board of Public Works of the City of South Bd, Indiana, parties of the first Second part, as follows, to wit: party of the WHEREAS, the said first parties desiring to construct and maintain a single tract siding across the first alley South of and adjoining the right -of- wat of said Railroad -Company, between Magnolia and Kosciuszko Streets in said City, which tracks are upon the right-of-way of said Railroad Company and the land of sand Cass Oil Company, save and except where the same crosses the alley between the said two streets. NOw, THIS WITNESSETH: that the second party does hereby grant unto said first parties the right to construct and maintain said side track across the said alley and in consideration of said grant, said first parties contract and agree to carefully and properly lay and maintain its said tracks across said alley at such'' grade as the Civil Engineer of said city may designate and to, at all times, maintain, either plank or other material as designated by said city on and along the alley where crossed by said side track and to keep said crossing open, at all times and upon j failure to to do the said grant shall null and void at the option of said second party and at its request said first parties, or either of them, will forthwith take up and move said such side tracks.
