FIRST AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT BY AND BETWEEN THE CITY OF SOUTH BEND BOARD OF PUBLIC WORKS AND CREATIVE FINANCIAL SERVICES, LLC This First Amendment of tile Professional Services Agreement between tile City of South Bend, Indiana acting by and through its Board of Public Works (tile "City") and Creative Financial Services, LLC ("Contractor") is effective as of the 7111 day of February 2018. WHEREAS, the City and Contractor entered into an Professional Services Agreement to be effective for approximately 60 days, commencing on December 6, 2017 and expiring oil February 7, 2018 for Contractor to provide professional services to assist City Water Works Department with accounting analysis work and other related activities. WHEREAS, the City and Contractor do now mutually desire to, amend certain terms of the Professional Services Agreement. NOW, THEREFORE, in consideration of the promises and mutual covenants contained in this First Amendment, the parties do hereby agree to amend their Professional Services Agreement as follows: Section 2, Consideration. Section 2 of the Professional Services Agreement provided for consideration in the amount of an hourly rate of Forty-two and 501100 Dollars ($42,50) per hour with total compensation not to exceed the surn.of Fourteen Thousand Dollars ($14,000) during the initial 60 day term. Section 2 is hereby amended to provide for additional consideration not to exceed Fourteen Thousand Dollars ($14,000) during extension of term. Section 3. Term and Renewal- The term of the Professional Set -vices Agreement shall be extended for a period of time not to exceed six months, commencing on February 7, 2018 and expiring on August 7, 2018. Except for the provisions herein contained, said Professional Services Agreement, including all Amendments, will remain in full force and effect as previously made.
