Bend City Clerk County -City Building, Suite 400 227 West Jefferson Blvd. South Bend, hidiana 46601 RE: Ray and Joan Kroc Corps Community Center Rezoning Petition Revision Dear Mr. Voorde: 051.60.02 On January 5, 2010, we submitted a petition for rezoning the site of the proposed Kroc Center to Planned Unit Development.. That petition has had first reading by the Common Council. The Area Plan Commission has scheduled a public hearing in their February 16, 2010 meeting. On behalf of The Salvation Army, the owner and operator of the facility, we are requesting an amendment to the petition to reduce the area included in the Planned Unit Developrrzent. . The original,petition submitted in January had the current owners of the property as co- petitioners. The current owners of the original petition area are: City of South Bend Parks & Recreation Board of Commissioners City of South Bend Board of Public Works South Bend Heritage Sherry John and Janette Miller The petition submitted in January had not been signed by Ms. John and Ms. Miller, but the other- three property owners had signed it. After several discussions, with Burkhart Advertising, which leases the John/Miller- property for an off - premises advertising sign, about provisions in the Planned Unit Development for their sign, we have decided to ornit the John/Miller property, and the South Bend Heritage property west of it, from the project area in order to be able to complete the rezoning process prior to the n1anned comrn.e*teerrient of construction of the Center in May. The area north of Western Avenue is shown on the site plan as being used for vehicle parking, with construction of that parking area as a second development phase.
