(j <br />By and Among <br />THE CITY OF SOUTH BEND, INDIANA Acting by and Through its <br />BOARD OF PUBLIC WORDS and its BOARD OF PARK COMMISSION, SOUTH <br />BENT) HERITAGE FOUNDATION, INC. and <br />THE SALVATION ARMY <br />The Ray and ,Toast Igoe Corps Community Center Project <br />!& JV , 2007 <br />THIS MEMORANDUM OF UNDERSTANDING, made effective the 16, Lday of <br />tSU, 2007, is entered into by and among THE CITY OF SOUTH BEND, INDIANA <br />acting by and through its BOARD OIL PUBLIC WORKS And Its BOARD OF PARK <br />COMMISSIONERS; SOUTH BEND HERITAGE ]FOUNDA.TTON, INC.; and THE <br />SALVATION ARMY, AN ILLINOIS CORPORATION. <br />RECITALS <br />WHEREAS, The Salvation Army Inc., an Illinois Corporation ( "Corporation ") is a not- <br />for- profit corporation having its offices at 10 W. Algonquin Road, Des Plaines, Illinois 60016; <br />and <br />WHEREAS, the Corporation conducts business in South Bend, Indiana and the <br />Corporation holds title to real property situated in Indiana through the The FS'alvution .Army, an <br />Illinois Corporation; and <br />WHEREAS, one of the Corporation's missions is to work with local communities and <br />facilitate development by establishing and implementing programs that are based upon various <br />community initiatives; and <br />WHEREAS, the Corporation is the recipient of a grant from Mrs, Joan Kroc, widow of <br />McDonald's founder Ray Kroe, to develop and build a number of Salvation Army facilities <br />supported in part by the local community that would assist The Salvation Army in carrying out <br />its mission ( "Ray and Joan if roc Corps Corrnmunity Center "); and <br />
