REGULAR MEETING FEBRUARY 27, 2018 58 <br />receipt of favorable recommendations concerning this Vacation Petition from the Area Plan <br />Commission, Fire Department and Solid Waste. Mr. Gilot advised the Board is in receipt of <br />unfavorable recommendations concerning this Vacation Petition from Community Investment <br />and Engineering, stating this vacation would make access to the lands of the aggrieved person by <br />means of public way difficult or inconvenient. Mr. Gilot states this could possibly be cured if a <br />cross access agreement is done with the affected property owner before taking the petition to the <br />Common Council. Therefore, Ms. Maradik made a motion recommending unfavorable of the <br />request for vacation. Ms. Fritzberg seconded the motion which carried. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE THE FIRST <br />NORTH/SOUTH ALLEY —14' IN WIDTH RUNNING NORTH —156' FROM NORTH RIGHT <br />OF WAY OF CAMPEAU ST., EAST OF N. ARTHUR ST. AND WEST OF WALSH ST. <br />Mr. Gilot indicated that Danch, Hamer & Associates, Inc., 1643 Commerce Drive, South Bend, <br />IN 46628, has submitted a request to vacate the above referenced alley. Mr. Gilot advised the <br />Board is in receipt of favorable recommendations concerning this Vacation Petition from the <br />Area Plan Commission, Police Department, Fire Department, Solid Waste, Community <br />Investment, Streets Department, and Engineering. Area Plan stated the vacation would not hinder <br />the growth or orderly development of the unit or neighborhood in which it is located or to which <br />it is contiguous. The vacation would not make access to the lands of the aggrieved person by <br />means of public way difficult or inconvenient. The vacation would not hinder the public's <br />access to a church, school or other public building or place. The vacation would not hinder the <br />use of a public right-of-way by the neighborhood in which it is located or to which it is <br />contiguous. Therefore, Ms. Maradik made a motion recommending approval of the request for <br />vacation. Ms. Fritzberg seconded the motion which carried. <br />APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO <br />REMONSTRATE —18505 FONTANA DRIVE — SEWER/WATER <br />Mr. Gilot stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to <br />Remonstrate as submitted by Century Builders LLC, 314 W. Catalpa Drive, Suite F, Mishawaka, <br />IN 46545. The Consent indicates that in consideration for permission to tap into public <br />water/sanitary sewer system of the City, to provide water/sanitary sewer service to the above <br />referenced property at 18505 Fontana Drive (Key # 002-1014-0273), the applicant waive(s) and <br />release(s) any and all right to remonstrate against or oppose any pending or future annexation of <br />the property by the City of South Bend. Therefore, Ms. Maradik made a motion that the Consent <br />be approved.
