Bus Company respectfully represents there heretofore, <br />on January I2th., I92I, O dXnaA87 was passed by the Common Council of the City <br />of South Bend and approvea by the blyor of said City. That said ordinance ratifi- <br />ed and confirmed a contract and amendment thereto graihting this petitioner <br />permission any` authority to operate busses on certain streets in the City of South <br />Bend. That subsequent to the approval of said ordinance the third route described <br />in said contract, which ran into the Southeast part of the.City >of South Bend was <br />abandoned by and with the acquiesence and consent of the municipal authorities <br />of the City of South Bend, but without formal amendment of the contract or amend- <br />ment of the ordinance. That subsequent to such abandonment the City of South Bend <br />through this Board and by ordinance duly adopted, granted permission and authority <br />to the Chi cagorp South Bend and Northern Indiana Railway Company to maintain and <br />operate motor busses in said southeast portion of said city. Said petitioner <br />would fatther.show that police regulations and orders have heretofore been made <br />requiring the encircling by all busses of the block in said city bibunded by Yaln, <br />Lafayette and Washington Streets and Jefferson Boulevard. That in conformity with <br />such orders this petitioner has been for sometime operating its busses around said <br />block. Said petitioner further reppectfully represents that -the inhanbitants of <br />that portion of the city bounding Division Street and lying Vest of Olive Street <br />desire bus service as far west as Iowa. Street on Division Street, and said petition- <br />er represents that the extension of its Division Street route from its present <br />Western Terminus at Olive Street to Iowa Street will be a public utility and a <br />general benefit. <br />11herefore this petitioner prays that the terms of the :contract now existing <br />between the petitioner and said city be modified with this petition. <br />signed Arthur L. Cilliom <br />Jones and Obenchain <br />Attorneys for South Bend <br />RESOLUTION. <br />17-otor Bus Co." <br />"Resolved by the Board of Public vrks of the City of South Bend, Indiana, <br />that the following is the exact form of contract which will consid ;red and adopted <br />in the matter of t_ie petition pf the South Bend Motor Bus Company heretofore filed <br />praying for the modification of certain provisions of the contract now existing <br />between said city and said compazW, which existing contract was confirmed and rati- <br />fied. by ordinance Number 2I37 of said city, approved January I2th., I92I." <br />CONTRACT. <br />"This agreement, made and entered into this I4th., day of April 1926, by <br />and between the City of South Bend by and through its Board of Public Ifforks, herein <br />Nter called first party, and the South Bend Ij-otor Bus Company, a corporation, <br />_k ereinafter, called second party, 'r'ITTTESSJTH: <br />That the consent, permission and authority are hereby given and granted by <br />firrst party to and vested in second party, its successors and assigns, to operate <br />its commercial vehicles commonly knoLm as motor busses, for the purpose of carrying <br />passengers, _or the period hereinafter specified, over the following streets and <br />routes in the City of South Bend, Indiana. <br />I. On '°'oath Main Street between Washington and Division Street; on Division <br />Street between main and Iowa Streets; on Lafayette Street between Division and <br />Washington Streets; on Washington between Lafayette and Main Streets. <br />2. On South Main Street between Washington Street and Jefferson Boulevard; <br />on Jefferson Boulevard between La,in Street and Lafayette; on Lafw,7ette between <br />idashington and Sample Streets; on West Sample Street between Lafayette and Franklin <br />Streets; on Franklin Street between Sample Street and Indiana Avenue; on Indiana <br />Avenue between Franklin and Kemble Avenue; on Kemble Avenue between Indiana and <br />Ewing Avenues; on 4ashington Street between Lafayette and Main Streets. <br />Said second party agrees to operate its said vehicles over said streets and <br />I' routes regularly and in accordance with a regular time schedule adequate to the <br />I convenience and necessity of the inhabitants of said city; second party further <br />agrees not to pick up any passengers at intersections of any of said streets with <br />the Chicago, South Bend and Northern Indiana Railway Company's tracks, except <br />f at the downtown starting points; second party also agrees to comply with the pro- <br />visions and regmirements of any ordinance now or hereafter in force in said city <br />i� <br />regulating such traffic. <br />First party further grants the right to second party to erect and maintain <br />suitable signs along said streets and routes, advertising its stopes and schedules. <br />I subject to regulation by the Board of Public Works of said City. <br />
