<br />book six (6), Page 73 , said point being the point of intersection of the;
<br />east line of Eddy Street with the _outherly line of South Bend Avenue; it
<br />thence running northeasterly, along the southerly line of South Bend
<br />Avenue, a distance of sixty -six (66) feet; thence running southerly to aid
<br />point on the south line of said lot, which point is fifty one feet E,nd
<br />eightand one-half inches (511-82") east of the southwest corner of said
<br />lot; thence running west, along the south line of said lot, s distance
<br />offifty-one feet and eight and one-half inches ( 51 t -81) to the southwest
<br />corner of said lot; thence running north, along the west line of said lol
<br />distance of aporoximately t�yenty-four and nine -tenths (24-9/10) feet toil

<br />That the certain tract of land, of vhich the above described property is

<br />Avenue under improvement ResolutionNo. 622 in the City of South Bend,
<br />Indiana.
<br />That the legal description of that part of said lot nO. 1. of Listenberge;,ts
<br />First Addition to the City of South Bend for :hick youa, petitioner desires a re -assessor' nt
<br />is as above set forth.

<br />Said improvement assesssmsfrbs which were so levied against the real estato
<br />and the amount and name of each said assessments which are now unpaid., and the number
<br />of installments thereof which are nou unpaid, are filed herewith and made a part of thi
<br />petition and are marked " ExhibitAn. j
<br />That after said assessments were levied against said land, the same was
<br />divided, your Petitioner herein purchasing that part of lot One (1) above described
<br />from William. Happ and Jessie Happ., his wife; deed of your Petitioner to this land bei.
<br />recorded at Book 191 at Page 329 in the office of the Recorder of St. Joseph County in
<br />said State.
<br />Your Petitioner further states that there is no interest now due on any o;
<br />said assessments, and there are no penalties or costs due thereon.
<br />In the event thatna reassessment shall be made as herein requested, the
<br />undersigned Petitioner agrees to sign and enter into an agreement and waiver in writing;)
<br />in the form and manner provided by late to be approved by the said Board of Public 'Works)
<br />for the privilege of paying such improvement reassessments in the number of installment
<br />required for the remainder of the ten year period granted under the original improvement
<br />assessment for said improvement; and it is understood that the undersigned Standard -
<br />Oil Company shall pay in full all such unpaid installments of said reassessment as the
<br />same shall become due against that part of Lot One (1) of which it is the owner,
<br />together with all costs and penalties that mgy be added thereto and all interest thereon,
<br />her•efore your Petitioner requests your Board to reassess the unpaid amount
<br />of the said improvement assessment, in1luding all unpaid interest thereon, so that that!
<br />part of Lot One (1) now owned by your Petitioner shall bear its fair and equitable pro-;
<br />portion of each unpaid assessment and all interest clue thereon and all penalties and
<br />costs, if any be due in the remaining• years of the ten year period and on the same
<br />dates.
