45 <br />MEETING--I.UXY 15, 1939 <br />- --- - -- --- - -- -- - --- - -- ---- -- -- --- --- -- --- -- --it- <br />Regular meeting of the Board of Public Works was held on._Monday, May a5,;1939, I <br />at 9:15 A.M. All members were present. Minutes of the previous meeting were -read and <br />approved and payroll of the Street Department in the amount "' of was approved. <br />Claim of L. Van Paris in the amount of $225.00 was Approved and ordered paid. <br />,/ Mr. Smith and Mr. Waterson of the Northern Inc�i;ana Railway Company, Inc. appeared � <br />before the Board and presented an agreement for the substitution of -buses for street- <br />cars on the South Michigan Street line. This agreement was taken under consideration. <br />j '/A group of property owners on West Sample Street in the vicinity of the 3000 bloek� <br />and the 800 block South Dundee Street presented a petition to the Board asking the <br />Board to stop Mr. A. Beisbeck from farming and raising livestock on the premises at <br />3106 W�st Sample Street. The matter was referred to the City Attorney for investigatiola. <br />CEMTERY DEPARTMENT: Mr. McNabb was present and requested permission to purchase oil � <br />or use on the roads at the City Cemetery. Mr. 'YoNabb was requested to obtain estimate <br />on the cost of oil and dowflakes and report to the Board at the next meeting. <br />/The City Attorney reported that he had investigated the complaint made by 11r. Walk Ir <br />concerning the situation at the dump near his residence and had checked law on the <br />matter. He reported that he had written to Mr. Walker stating what the city could do. <br />/A petition for the establishment of grade fort he east and west alley between <br />Donald Street and Bowman Street and from Sampson Street east to Hoke Street was re- <br />ferred to the City Engineer. <br />i The following agreement was entered into between the Board of Works and Reed <br />Brothers: <br />This agreement made and entered into by and between Reed Brothers of the <br />City of Mishawaka.. Indiana, by and through I. C. Reed, as party of the first <br />part, and, The City of SouthBend, Indiana, by and through its Board of P14blic <br />Works, as party of the second part, Witnesseth: <br />Whereas, party of the first part is the owner of certain articles of <br />road construction equipment, more particularly hereinafter described, and de- <br />sires to lease sane to the second party for use in road construction work, and, <br />Whereas, party of the second part being engaged in certain road construc- <br />tion work within the City of South Bend, Indiana, desires to lease said equipment, <br />NOVI, THEREFORE, it is stipulated and agreed that first party will lease <br />to second party the following described road construction equipment for which <br />party of the second part will pay to first party monthly rental as hereinafter <br />stipulated, the equipment, together with the agreed monthly rental, being des <br />critred as follows, to -wit: <br />1. 134 road forms and stakes being 1340 ft. Rental per month ------- $134.00 <br />It is stipulated and agreed that the effective date of this contract shall <br />be as of the date that said equipment shall be taken from the yard of the first <br />party in the City of Mishawaka, Indiana, which said date is the 26th day of April, <br />1939; that this contract shall date from said date and remain effective until <br />said articles so rented or leased have all been returned to the yard of first <br />party in the City of Mishawaka, Indiana. <br />It is further agreed that first party shall not be liable or accountable <br />to second party or employees of the second party using said equipment or for <br />any resulting injuries or damages occasioned by the use of said equipment; that <br />this provision shall cover such time as the equipment is being transported to <br />and from the yard of first party. <br />It is further agreed that second party will keep said equipment in good <br />repair replacing any and all parts that may become lost or damaged with new <br />parts or used parts which party of the first part may agree shall be used; that <br />said equipment will be returned to first party in as good condition as received, <br />wear and tear excepted; that all equipment will be thoroughly cleaned; that the <br />forms will be thoroughly greased wit}a a heavy or thick coating of grease and re- <br />placed within the yard in the same manner as received; that all articles will <br />be replaced within the yard of the first party as directed by first party or duly <br />acting agent. <br />It is further agreed that rental shall continue upon said equipment for so <br />long a time as the articles shall remain away from the yard of the first party <br />at the above designated price; that rental payments for said equipment will be <br />made in the name Reed Brothers and directed to the office of the said Reed <br />Brothers at 2022 North Main Street, City of Mishawaka, Indiana. <br />IN WITNESS'WHEREOF THE PARTIES HAVE HEREUNTO SET THEIR HANDS AND SEALS THIS 15th <br />day of May, 1939. <br />Reed Brothers <br />By I.
