43 <br />11EETING--FEBRUARY 202 1939 <br />TTeeting of the Board of Public Works was held on Monday, February 20, 1939, at <br />9:00 A.M. All members were present. Minutes of the previous meeting were read and <br />approved. Claims of the following suppliers in the amount of �q21363.02 were approved <br />and ordered paid: <br />J. P. Conboy for B. J. Co. 31.50 ySam Berman 10.00, <br />The Studebaker Corporation 1.44 + West Side hardware Co. 51.00 <br />A petition for the installation of street lights at the intersection of Indiana <br />Ave. and Magnolia Street and at the intersection of Dubail and Nash Streets was receive <br />The matter was referred to Mr. Qualls of the Electrical Department for investigation an <br />report. <br />;Trs. A. L. Flack appeared before the Board regarding an accident at the intersec <br />tion of Beyer Street and I41'shawa1l-a Ave. between her car and Street Department Truck #11 <br />at 1:20 P.M. on February'7, 1939. Mr. James Perry, driver of the Street Department car <br />was present and each gave his and her version of the accident. Mrs. Flack was advised <br />that an adjustor for the insurance company carrying the insurance on city trucks would <br />be no , i_f -te_d -- <br />Twyckenharn Land 'a Investment Company, throu"h its attorneys, Loomis & Hartzer, hav <br />again contacted the Board in regard, to Dmprovement Assessment Roll I•To. 2154--Fairview <br />Avenue Local Sewer and have furnished the Board a stateiAent from all of the bondholders <br />and bondo�lmers on said improvement consenting to said re -spread of assessment. The fol <br />lowing letter was addressed to r._r. lartzer: <br />• ✓ "Chapter 185 of the Acts of 1915 deals with the respreading of assess-nents <br />to newly platted property. It is ply opinion that TTou have not ccx:iplied with the <br />law in yd our petition. I think the petition should set out very clearly the legal <br />description of the property against which the assessment was orig finally made, the <br />platting of the property, the recording of the plat and so forth, and then should <br />ask for the respread of the assessments over the lots as shown on the plat. <br />✓ "Time will not permit me to digest this chapter for you; however, the feeling <br />of the Board is that if the statute is strictly complied with in the manner of <br />presenting the petition and all penalties aloe paid and a continuing bond is furnished <br />saving the Cityy and the Board of Public '.'forks and Safet7T harmless from any liability <br />of akin the respread, then we will accomodate you. However, it will be necessary <br />for �rou to f ollatvthe thing threvgh as the press of other business at this tires does <br />not permit us to spend any time on it.rt <br />Ylr. Zmudzinski, StreetConmissioner, was present and _iatterspertaining to his de- <br />partx-nent were discussed. The Street Corimissioner was authorized to purchase sufficient <br />' emulsified asphalt to make two tons of patching material as an experiment of the effee- <br />tiveness of this type of patching material. <br />. ✓ Upon request of the Honora'ale Ilan -or, the Bcard, on motion duly made, seconded and <br />carried, declared the following days to be Legal holidays in the city of South Bend, <br />Indiana: January 1, New Year1s Day; February 12, Lincoln's Birthday; February- 22, <br />Washington's Birthday; IrTa;r 30, Memorial Day; July4, Independence Day;: the first Monday <br />in September, Labor Day; the last ThursdalT in Novexber, Thanksgiving Day; and Decerber <br />25, Christmas Day. Any other special daTTs will be considered from t ix, e to time as the <br />case -:!ay arise. <br />Iir. H. L. Schreyer reported an accident which F. I:Torr s, one of his t-rucl.dri vers, <br />had in the eOO block N . Lafayette Street as a result of a manhole being uncovered.
